<br />78 <br /> <br />ORDINANCE NO. 138 <br /> <br />AN ORDINANCE AMENDING ORDINANCE NO. 105 ENTITLED "AN ORDINANCE FOR THE <br />PURPOSE OF PROMOTING THE PUBLIC HEALTH, SAFETY, ORDER, COMMERCE, PROPERTY <br />MID GENERAL WELFARE BY PROVIDING FOR THE CLASSIFICATION, REGULATION AND <br />RESTRICTION OF THE ERECTION OF TRADES AND INDUSTRIES MID OF BUILDINGS USED <br />FOR HUMAN HABITATION !lID FOR SPECIFIED PURPOSES, REGULATING AND DETI!.'RMINING <br />THE MINIMUM SIZE OF YARD AREAS, ESTABLISHING THE BREAKDOWN OF DISTRICTS FOR <br />SAID PURPOSES AND PROVIDING PENALTIES FOR VIOLATION THEREOF" AS AMENDED. <br /> <br />The Village Council of Roseville Ordains: <br /> <br />SECTION I <br /> <br />That Ordinance No. 105 as amended is hereby further amended by striking <br />out the second paragraph of Section 10 entitled "Residence'!astricts "A", <br />"B", and "C":" and inserting in lieu thereof the following: <br /> <br />Residence Districts "A", "B", and "C": <br />For every building hereafter erected, or structurally altered, <br />there shall be provided a front yard of not less than thirty (30) <br />feet in depth, and a side yard on each side of the building of not <br />less than five (5) feet in width, provided that where a building is <br />to be built so as to front upon a street other than the_ street upon <br />which the lot fronts, the village council may gr~lt permission for <br />such construction contrary to the provisions of this paragraph. <br />If at the time this ordinance becomes effective, existing houses on <br />fifty percent (50%) or more of the frontage of any block have a <br />predominant front yard different from that herein specified, all <br />buildings hereafter erected shall conf'orm to this predominant front <br />yard depth, provided this regulation shall not be interpreted so as <br />to require a front yard of more than forty (40) feet in depth. <br /> <br />SECTION II <br /> <br />This ordinance shall take effect and be in force from and after its <br />passage and publication. <br /> <br />Approved: Sept. 18,1951 <br /> <br />Mayor <br /> <br />(Seal) <br /> <br />~ <br /> <br />ClerIc <br />
