<br />III <br /> <br />ORDDlANCE NO. 151 <br /> <br />~' <br /> <br />"AN ORDIMAlCE AlIENDIHG ORDINANCE NO.l05ENTITLED "AN ORDINAlICE FOR THE <br />PURPOSE OF PROMOTING THE PUBLIC HEAL'l'H,SAFETY,ORDER,COIOOmCE,PROPERTY AND <br />GENERAL WELFARE BY PROVIDDlG FOR THE CLASSIFICATION ,REGULATION AND RESTRICTION <br />OF THE ERECTION OF 'l'RADES AHD INmSTRIES AND OF BUILDINGS USED FOR HUMAN <br />HABITATION AND FORSPECIFIEJl PURPOSFS,REGULATING .AND DETERMIJIING THE IlINDIUM <br />SIZE OF YARD AREAS,ESTABLISHING THE BREAKDOI!l OF DISTRICTS FOR SAID FURPOSES, <br />AND PROVmING PENALTIES FOR VIOLATION THEREOF." <br /> <br />The Village Council ot Rosevi.lle Ordains as tollows: <br /> <br />SECTION I <br /> <br />That Ordinance No. 105 entitled "An Ordinance for the Purpose ot PrOJloting <br />the Public Health,Satety,Order,CoDerce,Property and Genera11felfare by Provid- <br />ing tor the classification,Regulation,and Restric~ion of the ~ect1on of Trades <br />and Industries and or BuUdings used tor HUllan Habitation and tor specified <br />furposes,Regulating and Determining the Minimum Size ot Yard Areas,Establishing <br />the Breakdown of Districts for laid Purposes,and Providing Penalties for Viola- <br />tion Thereof" is hereby aaended striking troll Section 10 thereof the section <br />entitled "Business District" and inserting in lieu thereof the following: <br /> <br />"Business District: No building or business use except driveways for ingress <br />and egress shall be placed closer than thirty(30) feet froa any highway property <br />line,prov1ded,however,that in case ot gasoline fUling stations the gasoline pwlps <br />aay be placed at a dil!ltance of not less than twenty (20) feet froa such property <br />line. <br /> <br />n Side yards shall not be required tor any building except as tollows: <br /> <br />1. Dwellings, in which case this requireaent shall be the same as that in . <br />any residential district. <br /> <br />2. Buildings or use of any property which might be called roadside service <br />such as gasoline tilling stations,retreshaent stands,trailer camps, cabins,etc,J <br />in these eases the JIin1Jma side yards shall be twenty (20) feet. <br /> <br />Wlbere a business district adjoins a residence district there Shall be <br />provided along the boundary line a side yard of at least five (.5) teet. <br /> <br />SECTION II <br /> <br />This Ordinance shall take effect and be in force from and atter its <br />passage and publication. <br /> <br />Passed by the Council this 7th ~ of April,1953 <br /> <br />Attest: <br /> <br />~ <br /> <br />GEORGE S.
