<br />126 <br /> <br />SECTION 4 <br /> <br />Company shall supply natural gas which shall have an average gross <br />heating value of 1,000 Btu per standard cubic foot. Company agrees that, if <br />during any monthly period the arithmetic average of hourly gross heating <br />values of the gas supplied hereunder shall be less than 950 Btu per standard <br />cubic foot, then for billing purposes the consumption of gas as measured by <br />the customers' meters during such period shall be decreased in proportion to <br />the decrease in the average gross heating value below 950 Btu per standard <br />cubic foot. During the term of this Ordinance, natural gas shall be supplied <br />to the Village of Roseville, and its inhabitants, in accordance with the town <br />border contract under which Company purchases the natural gas to be supplied <br />hereunder; provided that Company shall not be deemed 'to be in default under <br />its franchise for inability to supply natural gas: for any causes beyond its <br />control, or as prevented by competent legal authority from so doing. During <br />the life of this Ordinance, the Village Council, and Company, may mutually <br />agree to change the heating value of the gas to be furnished, and in such <br />event the rates to be charged therefor shall be proportionately revised. <br /> <br />SECTION 5 <br /> <br />The rates to be charged by Company throughout the term hereof shall at <br />all times be just and reasonable, and subject to reasonable regulation by the <br />Village Council of said Village of Roseville. <br /> <br />SECTION 6 <br /> <br />The Company shall have the right and authority to prescribe and enforce <br />such reasonable rules and regulations governing the supply and sale of gas <br />se~ice, extensions to its mains and service, and the general conduct of its <br />business, as may from time to time be necessar,y, or advisable, for the protec- <br />tion of the public and the proper enjoyment of the right and privileges <br />herein granted. <br /> <br />SECTION 7 <br /> <br />This Ordinance shall not be construed to grant any exclusive right, <br />privilege, or franchise to the Company. <br /> <br />SECTION 8 <br /> <br />Co~pany shall, if it accepts this Ordinance and the rights hereby <br />granted, file a written acceptance of the franchise rights hereby granted with <br />the Village Clerk within ninety (90) days from the date of the publication <br />of this Ordinance. <br /> <br />SECTION 9 <br /> <br />( <br /> <br />This Ordinance shall be in full force and effect from and after its <br />passage and publication, as provided by law. <br /> <br />Passed and approved: July 27, 1953. <br /> <br />(SEAL) <br /> <br />George S.
