<br />EXTRACT OF MINUTES OF MEETING OF THE <br /> <br />CITY COUNCIL OF THE CITY OF ROSEVILLE <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />Pursuant to due call and notice thereof, a regular meeting of the City <br />council of the City of Roseville, County of Ramsey, Minnesota was duly <br />held on the 13th day of January, 1992, at 7:30 p.m. <br /> <br />The following members were present: P. Johnson, Thomas, Cushman, <br />Maschka, and V. Johnson, and the following were absent: None. <br /> <br />Member Thomas introduced the following resolution and moved its <br />adoption: <br /> <br />RESOLUTION NO. 8738A <br /> <br />RESOLUTION CONCERNING AGREEMENT IN MEDIATION <br />BETWEEN A PLUS INDUSTRIES, INC. AND THE CITY OF ROSEVILLE <br /> <br />WHEREAS, the Council has been presented with a proposed Agreement in <br />Mediation which addresses long standing issues between the city, A <br />Plus Industries, Inc., and numerous residents of the City, and which <br />provides for the settlement of pending civil and criminal litigation <br />between the City and A Plus Industries, Inc.; and <br /> <br />WHEREAS, the Council believes that the proposed Agreement is in the <br />best interests of the City; <br /> <br />NOW, THEREFORE, BE IT RESOLVED, that the city council of the city of <br />Roseville hereby approves the proposed Mediation Agreement, and <br />authorizes the Mayor and City Manager to execute the Agreement on <br />behalf of the City. <br /> <br />BE IT FURTHER RESOLVED, that this approval by the City is subject to <br />implementation of the Agreement by a stipulation to be entered into in <br />the pending litigation in a form satisfactory to counsel for the city. <br />This approval is also subject to implementation of the loan provisions <br />by documents in form satisfactory to counsel for the City. <br /> <br />The motion for the adoption of the foregoing resolution was duly <br />seconded by Member Cushman, and upon a vote being taken thereon, the <br />following voted in favor thereof: P. Johnson, Thomas, Cushman, <br />Maschka, and V. Johnson, and the following voted against the same: <br />None. <br /> <br />WHEREUPON said resolution was declared duly passed and adopted. <br />
