<br />44.080. Adoption of National Fire Code as Part of Fire <br />Prevention Code. There is hereby adopted by the Village of <br />Roseville for the further purpose of prescribing reasonable <br />regulation governing conditions hazardous to life and prop- <br />erty from fire or explosion that certain Code known as the <br />National Fire Code, published by the National Fire Protec- <br />tion Association, being the current edition thereof, of <br />which not less than three (3) copies have been received and <br />are now filed in the office of the manager and the same are <br />hereby adopted and incorporated as fully as if set out at <br />length herein, and the provision thereof shall be controlling <br />within the limits as set forth in Section 35.240 of the <br />Village Code. <br /> <br />44.090. Open Flame Fire on Wooden Balcony. No person <br />shall set, kindle, maintain or permit any fire or open flame <br />in any balcony of a multiple dwelling or apartment building <br />in any barbeque, torch or similar heating, cooking, burning <br />or lighting equipment or device, except in dwellings of all <br />masonry construction. <br /> <br />44.100. Permits Required. No person shall, without <br />first obtaining an annual permit, maintain, store or handle <br />materials, or conduct, process, or install equipment when a <br />permit is required by the Fire Prevention Code for any such <br />activity. A fee of $5.00 shall be paid for each permit, in <br />accordance with the conditions set forth in Section 1.9 of <br />said Code. <br /> <br />44.110. Revocation of Permits. The Office of the Fire <br />Marshal may revoke a permit or approval issued if any vio- <br />lation of the Fire Prevention Code is found upon inspection <br />or in case there has been any false statement or misrepresen- <br />tation as to a material fact in the application or plans on <br />which the permit or approval was based. <br /> <br />44.120. Appeals. Whenever the Fire Marshal shall <br />disapprove an application or refuse to grant a permit <br />applied for, or when it is claimed that the provision of <br />the Codes do not apply or that the true intent and meaning <br />of the Codes have been misconstrued or wrongly interpreted, <br />or when the office of the Fire Marshal has revoked a permit <br />pursuant to Section 44.110, the applicant may appeal from <br /> <br />-4- <br />
