CITY OF ROSEVILLE ORDINANCE NO. 881 * * * * * * * * * AN ORDINANCE REPEALING AND REST A TING CHAPTER 11 OF THE CITY CODE DEALING WITH NON-CONFORMING USES. The City Council of the City of Roseville does hereby ordain: I. Chapter 11 of the City Code of the City of Roseville is hereby repealed and restated to read as follows: 11. Non-Conforming Uses. 11.010. Definition. A non-conforming use is any use or arrangement of land or structures legally existing prior to the enactment of a Code provision prohibiting such use. 11.020. Existing Structures or Uses. Except where specifi- cally limited elsewhere in this Code, any non-conforming use may be continued, but may not be extended, expanded, intesntified, or changed, unless to a conforming use. 11.030. Damaged Non-Conforming Structure. Any non- conforming structure damaged to an extent of not more than fifty percent (50%) of its reproduction cost by fire, flood, explosion, or other casualty, may be reconstructed and used as before if such reconstruction is completed within six (6) months of the casualty. If the damage to the structure is greater than fifty percent (50%) of the replacement cost of the structure at the time of loss, as determined by the Council, the reconstruction shall be for a use in accordance with this Code. 11.040. Discontinued Non-Conforming Use. Whenever a non-conforming use shall have been discontinued for a period of six (6) months, it shall not return to the original or any other use which is non-conforming. 11.050. Maintenance of Non-Conforming Structures. Nor- mal maintenance of a structure containing or which is a non- conforming use is permitted, including necessary non-structural repairs and incidental alterations which do not extend, expand, or intensify the non-conforming use.
