<br />CITY OF ROSEVILLE <br />ORDINANCE NO. 881 <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />* <br /> <br />AN ORDINANCE REPEALING AND REST A TING CHAPTER 11 OF THE <br />CITY CODE DEALING WITH NON-CONFORMING USES. <br /> <br />The City Council of the City of Roseville does hereby ordain: <br /> <br />I. <br /> <br />Chapter 11 of the City Code of the City of Roseville is hereby repealed and <br /> <br />restated to read as follows: <br /> <br />11. Non-Conforming Uses. <br /> <br />11.010. Definition. A non-conforming use is any use or <br />arrangement of land or structures legally existing prior to the <br />enactment of a Code provision prohibiting such use. <br /> <br />11.020. Existing Structures or Uses. Except where specifi- <br />cally limited elsewhere in this Code, any non-conforming use may be <br />continued, but may not be extended, expanded, intesntified, or <br />changed, unless to a conforming use. <br /> <br />11.030. Damaged Non-Conforming Structure. Any non- <br />conforming structure damaged to an extent of not more than fifty <br />percent (50%) of its reproduction cost by fire, flood, explosion, or <br />other casualty, may be reconstructed and used as before if such <br />reconstruction is completed within six (6) months of the casualty. If <br />the damage to the structure is greater than fifty percent (50%) of the <br />replacement cost of the structure at the time of loss, as determined <br />by the Council, the reconstruction shall be for a use in accordance <br />with this Code. <br /> <br />11.040. Discontinued Non-Conforming Use. Whenever a <br />non-conforming use shall have been discontinued for a period of six <br />(6) months, it shall not return to the original or any other use which is <br />non-conforming. <br /> <br />11.050. Maintenance of Non-Conforming Structures. Nor- <br />mal maintenance of a structure containing or which is a non- <br />conforming use is permitted, including necessary non-structural <br />repairs and incidental alterations which do not extend, expand, or <br />intensify the non-conforming use. <br />
