<br />117. Amusement Devices <br /> <br />117.010. Definitions. <br /> <br />(1) An "amusement device" is an electronic or <br />mechanical game of skill or chance requiring the payment <br />of money to play or operate, is not a "gambling device" as <br />defined by Minnesota Statutes and is licensed by the City. <br /> <br />(2) An "amusement device manager" is an adult <br />employee of an establishment operating amusement de- <br />vices whose primary duties are the supervision of the <br />amusement devices <br /> <br />(3) A "game room" is a business establishment, <br />more than fifty percent (50%) of the gross receipts of <br />which are derived from the operation of amusement <br />devices, has an amusement device manager on the <br />premises during all hours of operation and is licensed by <br />the City. <br /> <br />117.020. Operation of Amusement Devices. Maintaining and <br />operating an amusement device in a business establishment is <br />prohibited, except: <br /> <br />(1) Up to four (4) licensed amusement devices may <br />be maintained and operated in any business establishment <br />in the City. <br /> <br />(2) Game rooms may maintain and operate in <br />excess of four (4) amusement devices between the hours <br />of 8:00 a.m. and 10:00 p.m. <br /> <br />(3) Business establishments, other than game <br />rooms, may maintain and operate in excess of four (4) <br />licensed amusement devices only upon the issuance of a <br />permit by the City Council, which permit may be denied <br />by the City Council in its sole discretion and which may <br />contain conditions such as a limitation on the number, <br />type, and hours of operation of the amusement devices. <br /> <br />117.030. Licenses Required. The following licenses and fees <br />apply to amusement devices: <br /> <br />(1) Amusement devices -- $50.00 per year per <br />amusement device. <br /> <br />(2) Game room -- $300.00 nonrefundable investi- <br />gation fee and $100.00 per game room per year license <br />fee. <br />
