<br />CITY OF ROSEVILLE <br />ORDINANCE NO. 903 <br /> <br />* * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * <br /> <br />AN ORDINANCE AMENDING THE SUBDIVISION CODE OF THE CITY ROSEVILLE <br />PROVIDING FOR A DEDICATION FOR PARK PURPOSES AT THE TIME OF SUBDIVISION. <br /> <br />The City Council of the City of Roseville does hereby ordain: <br /> <br />I. <br /> <br />Chapter 20 of the City Code of the City of Roseville is hereby <br />amended by adding a new Section 10.155, to read as follows: <br /> <br />20.155. Park Dedication. <br /> <br />(1) As a condition to approval of any subdivision of land zoned <br />or proposed to be zoned residential, five (5) acres or more <br />in area, the owner shall dedicate ten percent (10%) of the <br />gross area of such land to the City for public park, play- <br />ground, open space, trail system, or other public recrea- <br />tional purposes. <br /> <br />(2) Any land being dedicated as a requirement of this section <br />shall be reasonably adaptable to use for active park and <br />recreational purposes and shall be at a location convenient <br />to people to be served thereby. Factors used in evaluating <br />the adequacy of the areas to be dedicated shall include the <br />size, shape, topography, geology, vegetation cover, access, <br />and location. <br /> <br />(3) At the option of the City, and in lieu of such dedication, <br />the owner shall pay to the City for park purposes, an amount <br />of cash equal to the undeveloped land value of that portion <br />of the area to be subdivided which would otherwise be re- <br />quired to be dedicated. <br /> <br />(4) If a dispute arises concerning the amount of cash required <br />by paragraph (3), above, the amount shall be finally <br />determined by a qualified appraiser selected by the property <br />owner from a list of three (3) qualified appraisers supplied <br />by the City. <br /> <br />(5) Land dedicated pursuant to this section may not be used by <br />the owner as an allowance for the purposes of calculating <br />density requirements of the Zoning Code and shall be in <br />addition to open space requirements for Planned Unit <br />Developments required by the Zoning Code. <br />
