<br />interfere with other uses of streets. Grantee shall make .use of <br />existing poles and other facilities available to Grantee. <br /> <br />c. <br /> <br />Notwithstanding the above grant to use streets, no street shall <br />be used by Grantee if City in its sole opinion determines that <br />such use is inconsistent with the terms, conditions, or provisions <br />by which such street was created or dedicated, or with the <br />present use of the street. <br /> <br />( <br /> <br />SECTION 3. AGREEMENT <br /> <br />A. Grantee agrees to be bound by all the terms and conditions of <br />this Franchise. <br /> <br />B. Grantee also agrees to provide all services specifically set forth <br />in, and to comply with all provisions of, its Offering to provide <br />a System within the boundaries of City. Failure of Grantee to <br />provide a System as described in its Offering, at City's option, <br />shall be violation of the provisions of this Franchise. In the <br />event of conflicts or discrepancies between the Offering of <br />Grantee and the provisions of this Franchise, the provisions <br />which provide the greatest benefit to the City, in the opinion of <br />the Council, shall prevail. <br /> <br />SECTION 4. FRANCHISE TERM <br /> <br />This Franchise shall commence upon the effective date of the regular <br /> <br />certificate of confirmation issued by Board and shall expire fifteen (15) years <br /> <br />from date of acceptance. <br /> <br />SECTION 5. AREA <br /> <br />This Franchise is granted for City as it exists from time to time during the <br /> <br />term of this Franchise. <br /> <br />SECTION 6. POLICE AND EMINENT DOMAIN POWERS <br /> <br />A. <br /> <br />Grantee's rights are subject to the rights of eminent domain of <br />the City and to the police power of City to adopt and enforce <br />ordinances necessary to the health, safety, and welfare of the <br />public, <br /> <br />l <br /> <br />B. Any conflict between the provisions of this Franchise and any <br />other present or future lawful exercise of the right of eminent <br />domain and the police powers of City shall be resolved in favor <br /> <br />_ 7 _ <br />
