<br />( <br /> <br />Grantee and any other person shall neither initiate nor use any <br />procedure or device for monitoring individual viewing patterns <br />or practices or otherwise procuring or storing or selling <br />information or data from a subcriber's terminaHs) by any other <br />means, without the prior authorization of the affected <br />subscriber which shall not have been obtained from the <br />subscriber as a condition of providing service. The request for <br />such authorization shall be contained in a separate document <br />which prominently states that the subscriber is authorizing with <br />full knowledge of the authorization provisions and which <br />identifies the purpose for which the data or information is being <br />gathered or stored. Such authorization shall be for a limited <br />period of time not to exceed one year. The authorization shall <br />be revocable at any time by the subscriber without penalty of <br />any kind whatsoever. A separate authorization shall be required <br />for each type or classification of data or information sought <br />from a subscriber terminal. <br /> <br />B. <br /> <br />Grantee shall not, without the written authorization of the <br />affected subscriber, provide to anyone data identifying or <br />designating any subscriber. Any data, the collection of which is <br />authorized, shall be made available upon request by and without <br />charge to the authorizing subscriber in understandable fashion, <br />including specification of the purpose for which the information <br />is being gathered and to whom and for what fee the information <br />is to be sold. <br /> <br />C. <br /> <br />Grantee shall not tap or monitor, arrange for the tapping or <br />monitoring, or permit any other person to tap or monitor, any <br />cable, line, signal input device, or subscriber outlet or receiver <br />for any purpose whatsoever, without the prior written <br />authorization of the affected subscriber as required by <br />paragraph A of this Section. <br /> <br />D. <br /> <br />Nothing herein contained shall prohibit Grantee from verifying <br />System operation and the transmission of signals to an affected <br />subscriber or from monitoring for the purpose of billing. The <br />information obtained pursuant to the subsection shall be subject <br />to the provisions of this Section relating to confidentiality. <br /> <br />SECTION 10. CER TIFICA TE OF CONFIRM A TION <br /> <br />(, <br /> <br />Grantee shall abide by the then current rules and regulations of Board <br /> <br />regarding the application, approval, and renewal of a Certificate of <br /> <br />Confirmation. Failure of Grantee to obtain a Certificate of Confirmation or a <br /> <br />renewal thereof shall result in automatic termination of this Franchise, and this <br /> <br />- 9 - <br />
