<br />( <br /> <br />adopted or determined by City or the Board <br />regarding access channels. Such requirements of the" <br />Board are hereby made a part of this ordinance and <br />includes the following: <br /> <br />(a) Grantee shall, to the extent of the System's <br />available channel capacity, provide to each of <br />its subscribers who receive all or any part of <br />the total services offered on the System, <br />reception on at least one specially designated <br />noncommercial public access channel available <br />for use by the general public on a first come, <br />nondiscriminatory basis; at least one specially <br />designated access channel for use by local <br />educational authorities, at least one specially <br />designated access channel for local <br />government use; and at least one specially <br />designated access channel available for lease <br />on a first come, nondiscriminatory basis by <br />commercial and noncommercial users (the <br />preceding hereinafter referred to as the <br />"access channels"). Subscribers receiving only <br />alarm system services or only data <br />transmission services for computer operated <br />functions shall be exempt from this <br />requirement. The VHF spectrum shall be used <br />for at least one of the specially designated <br />noncommercial public access channels <br />required. No charges shall be made for <br />channel time or playback of prerecorded <br />programming on at least one of the specially <br />designated noncommercial public access <br />channels. Any fees for use of public access <br />channels shall be consistent with the goal of <br />affording the public a low cost means of <br />television access. Access facilities, equipment <br />and/or channel time will be made available to <br />the general public, any group or individual <br />resident in the City for the production and/or <br />cablecasting of noncommercial programming <br />free of charge on a first come, <br />nondiscriminatory basis. <br /> <br />l <br /> <br />(b) Whenever any of the access channels is in use <br />during 80 percent of the weekdays (Monday- <br />Friday), for 80 percent of the time during any <br />consecutive three hour period for six weeks <br />running, and there is demand for use of an <br />additional channel for the same purpose, <br />Grantee shall then have six months in which to <br /> <br />- 14 - <br />
