<br />( <br /> <br />(a) City shall provide Grantee with a written <br />notice of City's intention to terminate the <br />Franchise and the reason or cause for proposed <br />termination. City shall allow Grantee a <br />minimum of thirty (30) days subsequent to <br />receipt of the notice in which to correct the <br />default. <br /> <br />(b) Grantee shall be provided with an opportunity <br />to be heard at a public hearing prior to any <br />decision to terminate this Franchise. <br /> <br />(c) In the event that City determines to terminate <br />this Franchise, the Grantee shall have a period <br />of thirty (30) days, beginning the day next <br />following written notice to Grantee of such <br />decision, within which to file an appeal with <br />the Board, pursuant to the then applicable <br />statutes and procedures of the Board. Any <br />such appeal to the Board shall be a contested <br />case to which the Board shall not be a party. <br />During such thirty (30) day period and until the <br />Board determines the appeal, if an appeal is <br />taken, the Franchise shall remain in full force <br />and effect, unless the term thereof sooner <br />expires. Grantee shall pay all costs of any <br />unsuccessful appeal, including reasonable <br />attorneys' fees incurred by City. <br /> <br />(d) If Board approves of the action of City, the <br />Franchise shall terminate immediately. If <br />Board disapproves of the action of City, the <br />Franchise shall remain in full force and effect <br />for the full term hereof unless sooner <br />terminated in accordance with the provisions <br />hereof, or applicable law or rules of Board. <br /> <br />SECTION 2. CROSS DEFAULT <br /> <br />A. <br /> <br />If Grantee should be in default under any of the terms or <br />provisions of a franchise, or acceptance thereof, of another <br />city, which was a party to a Joint Powers Agreement on April I, <br />1982, at City's option, to be exercised by notice to Grantee <br />given at any time which such default exists, such default may <br />be deemed by City a default by Grantee under this Franchise. <br /> <br />l <br /> <br />B. This section, or any other section or provision of this Franchise, <br />shall not be deemed to incorporate into this Franchise by <br />reference any other franchises. <br /> <br />- 51 - <br />
