<br />( <br /> <br />l <br /> <br />E. <br /> <br />To the extent any provision of the Offering is not specifically set out <br />in this Franchise or not validly incorporated herein by reference, City <br />from time to time may amend this Franchise to include such provision <br />effective as of the date of commencement of the Franchise term or <br />any such rule effective as of the date of commencement of the <br />Franchise term or adoption of the rule, which is later. Grantee, by <br />acceptance of this Franchise, consents to and agrees to be bound by <br />any such amendments. <br /> <br />F. If any term, condition, or provision of this Franchise or the <br />application thereof to any person or circumstance shall, to any <br />extent, be held to be invalid or unenforceable, the remainder hereof <br />and the application of such term, condition, and provision to persons <br />and circumstances other than those as to whom it shall be held invalid <br />or unenforceable shall not be affected thereby, and this Franchise and <br />all the terms, provisions, and conditions hereof, shall, in all other <br />respects, continue to be effective and to be complied with, subject to <br />the rights of City as delineated in paragraph D of this Section. <br /> <br />SECTION 6. GRANTEE ACKNOWLEDGMENT OF VALIDITY OF FRANCHISE <br /> <br />Grantee acknowledges that it has had a opportunity to review the terms <br /> <br />and conditions of this Franchise and that under current law Grantee believes that <br /> <br />said terms and conditions are not unreasonable or arbitrary, and that Grantee <br /> <br />believes the City has the power to make the terms and conditions contained in <br /> <br />this Franchise. <br /> <br />- 60 - <br />
