CITY OF ROSEVILLE ORDINANCE NO. 998 * * * * * * AN AMENDMENT TO SECTION 8.370 AND SECTION 12.055(1), PROVIDING FOR VARIANCES TO THE NONMOTORIZED PATHWAY REQUIREMENTS OF THE CODE. The City Council of the City of Roseville does hereby ordain: I. Section 8.370 of the City Code of the City of Roseville is amended to read as follows: 8.379. Nonmotorized Pathways Required. On all properties which are on the City's official nonmotorized pathway system, established by resolution of the Council and on all tax exempt property and Bl through B-4 and shopping center zoned properties, regardless of whether or not they are on the official pathway system, where there is new building construction or renovation where the renovation value is fifty percent (50%) or more of the pre-renovation value of the structure, nonmotorized pathways shall be constructed by the property owner in the public right-of-way, at a place prescribed by the Public Works Direct04r. Excepted from this requirement are non-tax exempt R-l and R-2 properties. In lieu of construction of a nonmotorized pathway, described herein, the property owner may pay to the City an amount equal to the cost of the nonmotorized pathway to satisfy the obligations of this section. Said payment shall be used by the City for further maintenance and construction of the nonmotorized pathway system within the City. A property owner seeking a variance from the requirement of this section may apply for such variance pursuant to the minor variance procedures of Section 12.055. II. Section 12.055(1) of the City Code of the City of Roseville is amended to read as follows:
