are unwilling to negotiate with the Village of Roseville on a reasonable basis for the acquisition of the same; and WHEREAS, the statutes of the State of Minnesota state that the Village has the power and authority to take and acquire said property by condemnation under the power of eminent domain; NOW~ THEREFORE~ BE IT RESOLVED By the Village Council for the Village of Roseville, Minnesota, as follows: The Village Council hereby deems that it is necessary and convenient that perpetual easement over the property described below be acquired by said Village by condemnation being situated in the County of Ramsey and State of Minnerota, to-wit: TRACT NO. 1 (Easement ST 106) The West 7.5 feet of Lot 7 and the East 7.5 feet of Lot 8, Garviks Homesites, according to the plat thereof on file and of record in the office of the Register of Deeds of Ramsey County, Minnesota, together with a temporary construction easement for one (1) year lying ten feet (101) on either side of the afore- described perpetual easement. The said perpetual easement to be for a depth of 8 to 10 feet. That the estate to be acquired in the property des- cribed above is a perpetual easement for constructing, main- taining, operating, and repairing storm sewer mains, pipes and appurtenances over and across said property, together with ingress and egress. That the Village Attorney be and hereby is in- structed to institute the necessary proceedings in condemnation under the power of eminent domain in the name and in behalf of the Village of Roseville, Minnesota, to acquire the property hereinabove described under the statutes of the State of Minnesota, and the said attorney is further in- structed and directed to take such steps as may be necessary to carry said proceedings to a conclusion. -2-
