EXTRACT OF MINUTES OF MEETING OF THE VILLAGE COUNCIL OF ROSEVILLE, MINNESOTA, HELD OCTOBER 2, 1965. * * * * * * * * * * * * * * * * * * Pursuant to due call and notice thereof a special meeting of the Village Council of Rosevil1e, Minnesota, was duly called and held at the Village Hall in said Village on October 2, 1965, at 9:30 A.M. The following members were present: Mayor Cedarholm, Trustees Curley, Goodrich, Grauel and Shields and the following members were absent: None Member Curley introduced the following Resolution and moved its adoption: RESOLUTION NO. 1349 A RESOLUTION DETERMINING TO ACQUIRE BY EMINENT DOMAIN EASEMENTS ACROSS CERTAIN LANDS FOR THE PURPOSES OF CONSTRUCTING, ~~INTAINING AND OPERATING FLOWAGE EASE~ffiNTS, FOR THE FLOWAGE, STORAGE, PONDING AND DISCHARGE OF STORM WATERS FOR THE VILLAGE OF ROSEVILLE, MINNESOTA, AND THAT THE NECESSARY PROCEEDINGS BE COMPLETED FOR SAID PURPOSE, AS APART OF IMPROVEMENT 65- 8: WHEREAS, the Village Council for the Village of Rosevil1e has been advised by competent engineers that it is feasible to con- struct flowage easements for the flowage, storage, ponding and discharge of storm waters for a portion of said Village, known as Improvement 65-8; and WHEREAS, the Village Council deems it necessary and expedient and in the best interests of the Village and its inhabitants that easements for flowage, storage, ponding and discharge of storm waters be constructed on the lands proposed to be taken by eminent domain hereunder; and WHEREAS, the present owners and the other persons having an interest in said required lands have indicated that they are unwilling to negotiate with the Village of Roseville on a reasonable basis for the acquisition of the same; and WHEREAS, the statutes of the State of Minnesota state that the Village has the power and authority to take and acquire said property by condemnation under the power of eminent doma~; '-- NOW, THEREFORE, BE IT RESOLVED BY THE Village Council for the Village of Roseville, Minnesota, as follows: The Village Council hereby deems it necessary and convenient that perpetual easements over the property described in Exhibit "A" attached hereto and made a part hereof be acquired by said Village by condemnation.
