<br />Chair Klausing opened the hearing and requested Thomas Paschke to provide a summary from the staff report <br />dated June 9, 1999. Edward Her requested a 22.8 foot variance from Section 703.04 of the City Code to reduce the <br />required driveway access point setback from 30 feet to 7.2 feet. Staff recommended approval. Thomas Paschke <br />noted the driveway curve, the pine trees, and the functionality of the drive created the hardship. <br /> <br />Mr. Ed Her, 2771 Woodbridge, noted the driveway has been there since at least 1989. The drive would have to be <br />relocated through the front lawn. The traffic is very light on this street. <br /> <br />Chair Klausing noted a letter from Pollocks supporting the proposal. <br /> <br />There being no further comment, Chair Klausing closed the hearing. <br /> <br />Motion: Member Rhody moved, seconded by Member Wilke, to recommend approval of the request for a variance <br />from Section 703.04B(4) of the City Code, to reduce the required driveway setback for property located at 2771 <br />Woodbridge Street from 30 feet to 7.2 feet or a 22.8 foot variance, based on the following findings from the staff <br />report dated June 9, 1999: <br /> <br />The Pavement Management Program and its reconstruction of Woodbridge Street have initiated this <br />request. <br /> <br />Section 1013.02 requires the applicant to demonstrate a physical hardship and to demonstrate that no <br />practical alternatives exist that would reduce the need for a variance. <br /> <br />Relocating the access point to meet the 30-foot setback may impact two mature trees and potentially require <br />their removal. <br /> <br />Requiring the driveway access point to be adjusted in any capacity would require major modifications to the <br />existing driveway as it extends to the garage. <br /> <br />The proposed variance, if granted, will not adversely affect the public health, safety or general welfare, <br />provided standards/conditions are attached to insure that redevelopment of the site is completed in <br />accordance with the plans proposed by the applicant. <br /> <br />Ayes: 5 <br /> <br />Nays: 0 <br /> <br />7. Presentations and Other Actions <br /> <br />7a. Discussion of Planning Commission By-laws <br /> <br />Member Rhody asked that the by-laws be tabled to the July meeting. Chair Klausing noted the changes he requested: <br />1. Changes to mission statement, page 1 <br />2. Code Chapter 201, change "pro-tem" to "vice chair" <br />3. Meeting time to be indicated <br />4. Graceful exit <br />5. Conduct of hearing, page 6 <br />6. Appendix B <br />7. Appendix D - change date <br />8. Appendix J - change font <br /> <br />Member Olson asked that clarification be given to the debatability of a "table motion". <br /> <br />Motion: Member Rhody moved, seconded by Member Wilke, to adopt the revised by-laws and recommend approval to <br />the City Council. <br /> <br />Ayes: 5 <br /> <br />Nays: 0 <br /> <br />8.
