Joe Jamnik noted that signage must be screened or <br />turned off if they face residences. <br /> <br />Mr. John Ridge, 1454 Eldridge, submitted written questions for Har Mar situation concerning: <br />1. 60 foot setback <br />2. rear yard setback of 120 feet <br />3. how is loading and servicing defined <br />4. minimal requirement of buffer zone width (40 feet to property line) <br />5. does the city own land between Pascal <br />6. is the city property part of buffer or setback <br />7. will the 120 and 60 foot setbacks be required for entire building or just expansion <br />8. why is there no buffer strip behind the apartments <br />9. lot area measurement vs building area (25% coverage) <br />10. what are fence requirements along edges of shopping centers. <br /> <br />Chair Klausing noted a letter received by Reinhardt Development. <br /> <br />Milow Gaul, 1963 Asbury, noted that not all residents are opposed to Har Mar. <br /> <br />John Synocki, 1378 W. Ryan, asked if the ordinance would address additional access points to be installed from SC into <br />residential areas. (There is a section [page 3, line 42] in the proposal as it is submitted). Could the access issue be <br />addressed in the Code? <br /> <br />Mr. Synocoki asked what is the definition of a front yard. What is the frontage at Har Mar? <br /> <br />Robert Olsen, attorney representing M. J. Wiko, owners of Crossroads stated he will submit comments at a future date. <br />His client did not receive notice until the day of the hearing. <br /> <br />... ... ... ..... 10 minute break ... ... ... ..... <br /> <br />Jeremy Jillis, 1386 Ryan, asked if the proposed Code was different for Shopping Centers vs. other areas? (No, hours are <br />stipulated in current Code; noise standards are the PCA standards throughout the community such as construction noise). <br />Does the 25% lot coverage include the buffer areas? (Yes). <br /> <br />Wendell Brown, 2723 N. Griggs, noted that the seniors are uncomfortable with traffic; but do like one-stop shopping, <br />especially Har Mar. <br /> <br />Comments from the public: <br /> <br />Joanne Kosack, 1426 W. Eldridge, noted that a large fence, which cannot be seen through, creates a safety hazard. It is <br />nice to see what is on the other side of a fence before going/walking there. <br /> <br />Ron Belchoski, 1391 Ryan, expressed appreciation for new ordinances that protect residences near shopping centers. <br /> <br />Donna Bessmer, 1421 W. Burke, expressed concern with traffic backups along County Road B, east to Hamline. Drivers <br />avoid the traffic by turning on Pascal to Burke to Hamline, with speeds as high as 45 mph. Semi-trucks have used Burke. <br /> <br />Shelley Mulken, Manager of Rosedale Commons, submitted a letter dated December 8, 1999, noted that Rosedale <br />Commons would become non-conforming. Delivery and maintenance after hours should be allowed. Restrictions on <br />lighting, snow plowing, and pickups would make operations at this Center difficult. She was concerned about deliveries at <br />early hours (i.e., Linens and Things at 5:00 a.m.). Toys-R-Us, Computer stores, FuncoLand do have occasional late night <br />deliveries. <br /> <br />Linda Fisher, 1500 Northwest Center, attorney representing Bradley, asked the Planning Commission to enter written <br />comments of 12.08.99 into the record. Bradley owns two shopping centers: Har Mar and Roseville Center. <br /> <br />Har Mar strives to be a good land use neighbor. Ms. Fisher stated that the proposed ordinance is difficult because: <br />1. There is a very broad period of applicability and any activity during anyone hour from 10 p.m. to 7 a.m.; <br />2. The ordinance is proscriptive with broad triggering events; <br />
