Planning File 3401: Request by the City of Roseville for re-affirmation of a Conditional Use Permit for <br />Northco, 1656 Terrace Drive, for use of site as truck terminal. <br /> <br />Chairman Duncan opened the hearing on reaffirmation of the original Conditional Use Permit and requested Community <br />Development Director Dennis Welsch provide a summary of the project report dated June 5, 2002. <br /> <br />Northco Real Estate Services has requested a reaffirmation of a pre-existing special use permit to continue to operate a <br />truck terminal in an 1-2 zone located on a tier of lots south of Terrace Drive and west of Lincoln Drive, west of the <br />Roseville Square Shopping Center. <br /> <br />The City Zoning Code was originally adopted as Ordinance 275 in 1959. In this Ordinance, truck terminals were approved <br />by issuance of a Special Use Permit (now called a Conditional Use Permit). The City record keeping was inconsistent in <br />those years - no record can be found of the actual Special Use Permit or Council Action. Staff presumes that a Special <br />Use Permit was issued for the Terminal Building located at 1656 Terrace Drive in 1972 or 1973 because the building is <br />consistent with both the Comprehensive Plan and the Zoning at that time. A building permit was issued for the <br />construction of the building on 4.3 acres in 1973. <br /> <br />For record keeping and financial reasons, Northco Real Estate, the current owner, and Clark Brothers Transfer have <br />requested the City provide either a copy of the original permit or a reaffirmation of the permitted conditional use on the <br />site. <br /> <br />There being no further comment Chair Duncan closed the hearing. <br /> <br />Motion: Motion by Member Duncan, seconded by Member Bakeman, to recommend adoption of a resolution <br />(draft attached), which reaffirms the current truck terminal use on the Northco site, located a 1656 Terrace Drive, <br />as use permitted by a Conditional Use Permit as per Section 1007.03 C4. <br /> <br />Ayes: 5 <br />Nays: 0 <br /> <br />Motion carried. <br /> <br />Chair Duncan recommended this action to take place prior to the B-6 rezoning decision by the Council. <br />h. Planning File 3403: Request by the City of Roseville in cooperation with the Wildlife Rehabilitation Center <br />to relocate an existing easement and sanitary sewer line, through the easement vacation process, in the <br />parking lot of 2530 Dale Street. <br /> <br />Chairman Duncan opened the hearing and requested City Planner Thomas Paschke provide a summary of the project <br />report dated June 5, 2002. <br /> <br />The Wildlife Rehabilitation Center is in the process of finalizing the location for their new headquarters building. The <br />Wildlife Rehabilitation Center in conjunction with their new headquarters development are requesting the vacation of a <br />certain utility easement, which lies within building limits. The proposal calls for a new utility easement to be established <br />directly adjacent (south) the current easement and for the existing utilities to be reconstructed within said new easement. <br />Based on the proposed plan and the provision of a utility easement prior to the relocation of utilities, the existing easement <br />area identified on the attachment is no longer necessary. <br /> <br />The Roseville Engineering Department has approved, with the addition of a manhole, the proposed design and plans to <br />relocate public utilities. They have determined there is no change in the capacity of the utility services, and only a minor <br />addition to the flow. As-built drawings will be required upon completion of the relocation. The Engineering Department has <br />also determined the proposed easement to be adequate to accommodate the reconstruction of the existing utilities. <br /> <br />Deb Bloom noted the sanitary sewer is currently not within an easement. <br /> <br />There being no further comment the hearing was closed. <br /> <br />Motion: Motion by Member Bakeman, seconded by Member Peper, to recommend approval of the request by the <br />Wildlife Rehabilitation Center to vacate a certain portion of an existing utility easement, accept the replacement <br />easement description establishing the new utility easement, and approve the relocation of a portion of an <br />existing sanitary sewer, within the parking lot at 2530 Dale Street based on the findings in Section 4 of the project <br />report dated 06/05/02. <br />
