<br />Thomas Paschke noted that he has received letters of support and one letter of concern regarding the St. Rose <br />site. Chair Duncan received a letter from Sara Barsel, PhD., which was read into the record (attached). Paschke <br />reported that neighbors near the Bethany lot asked that the lot be open later. <br /> <br />Member Peper asked if the IUP included all sites (No, only parking lots in R-1 zoning districts). <br /> <br />Randy Neprash noted that the access to St. Rose is on Dellwood. There are no sidewalks. The safety concern is <br />for over-flow parking along residential streets. The increased traffic and parking on Dellwood at the same time <br />create safety issues. Staff did not report on afternoon and evening traffic. Mr. Neprash suggested signage along <br />Eldridge and Dellwood. <br />Member Stone asked how deep into the neighborhood does the parking extend. (Eldridge, Belmont, Dellwood, <br />Skillman). Would the City have to regulate parking "deeper" into the neighborhood? The lot is not used on <br />Saturdays and Sundays. <br /> <br />Dr. Barsel suggested that Dellwood, as a narrow street, is most heavily used without safety issues for pedestrians. <br />It is not as significant on east-west streets. <br /> <br />Steve Grans, State Fair, noticed that the surrounding communities use "no parking, residents only" signs that have <br />worked. <br /> <br />Kenneth Lancaster, Glueck Lane, noted that the fair is here every year and creates a difficulty each year. He <br />described frontage roads with no parking as a solution and suggested no parking on Fernwood at Dellwood year <br />round to solve problems. <br /> <br />Deb Bloom noted permanent no parking signage requires a neighborhood public hearing. Parking signage has an <br />impact on adjoining streets so it involves everyone. <br /> <br />Chair Duncan asked if signage by St. Rose could be expanded into the neighborhood - no enforcement. Thomas <br />Paschke suggested a neighborhood meeting to hear from property owners before any actions; suggested a <br />recommendation to Council on this issue. <br /> <br />Member Traynor said as a general rule the City should not advocate St. Rose putting up signs and agreed with <br />holding a neighborhood meeting. <br /> <br />Sherman Miller, 1285 Skillman (corner of Dellwood and Skillman) advised that in 38 years, there have been only 28 <br />years that St. Rose puts up signs. He also noted that there have only been 2 accidents in the neighborhood. The <br />intersection has since had a stop sign installed and there haven't been any problems since then. <br /> <br />No motion offered. <br /> <br />b. Planning File 3329: Agness/Shorn Office - Interim Use Permit. <br /> <br />When Kathleen Agness requested an Interim Use Permit (City Code Section1012.09) on the property located at <br />2256 Lexington Ave to establish a realty and mortgage office, the Council adopted Resolution 9941 (September 24, <br />2001) which states that an annual administrative review be done and reported to the Planning Commission and <br />City Council. Dennis Welsch explained the staff report. <br /> <br />Kathleen Agness is legally operating an interim use office which includes Schorn Realty and River Valley <br />Mortgage, at 2256 Lexington Avenue in a residential building formerly known as the Rymer Music Academy and <br />formerly a single family home within an "R-1" Single Family zoning district. To date the zoning remains "R-1"; the <br />Comprehensive Plan remains "LDR" Low Density Residential. <br /> <br />One of the purposes of the Interim Use Permit is to preserve the character of the original residential architecture <br />and site improvements and the compatibility with the existing neighborhood. <br /> <br />The Council determined that the proposed office within a residential structure was an interim use. <br /> <br />The City has received two types of comments from neighbors: 1) Fix the damaged fence and 2) maintain the front, <br />side, and back yard. No comments or reports have been submitted by police, fire, or building inspection. <br /> <br />Motion: Member Duncan moved, seconded by Member Pepper to recommend approval to the City Council <br />(regarding conformance with the conditions of the IUP and continuance of the Agness/Schorn Interim Use <br />Permit), but also that the City not offer the Borders and Buffers program as a fence solution. <br />
