Itl is the Council's intentiOn to encourage the installation of street lighting throughout the city to promote the general health, safety and welfare of the citizenSI of the city. ('81 Code, g 18-1) , (B) Location. (1) The COUlilcil, upon a petition of at least 35% of the property OWners in an existing subdivision or developed area or upon its own initiative, shall determine the stlieets, parks or other public and private areas on which the city shall install and operate a street lighting system. (2) Before any service is furnished, the Council shall schedule a hearing pursuant to the prOVision of M.S. Chapter 429, as amended, at which time the Council will consider the project. I , (3) The city rt,ay pay a portion of the costs of installation of street lighting systems as thE:l Council may by policy determine from general ad valorem tax levies or f;om other revenues or funds of the' city available for that purpose. In the event !the Council elects not to pay all of the installation costs, the remaining unpaid ~ortlon shall be assessed against the benefitted property owners as a public improvement following a pUblic hearing and in full accordance with the provisions of M.S. Chapter 429, as amended. ('81 Code, 9 18-2) (Ord. 210, passed 9-28-78) (C) Operating costs; assessments. (1) The City Clerk shall keep a record Of the costs Of operation, maintenance and replal!:ement of the street lighting system including clerical, administrative and incidental costs. (2) Those costs shall be apportiOned to each lot and parcel of property benefitted by the streed lighting system, whether or not the property abuts the street or other public 011 private area in which the system is located. Further, the costs shail be apporitioned to similar classes of property. similarly. (3) The City Cbuncil, based on the information, shall by resolution, determine the rate to be paid by each Jot or parcel. (4) The City Clerk shall, monthly, prepare a bill based on the adopted rate for each lot Or pardel. The bill may be added to the water and sewer billing for each lot or parcel bepefitted by the street lighting system.
