Member Fischer commented on leak detection equipment that is provided
to gas station owners by the MPCA to monitor their gas tanks. He said the
MPCA has had some trouble monitoring the equipment. He suggested the
watershed may want to look into that situation to head off any problems.

Member Shiely commented on the economic impact amount used in the
presentation and said that the opportunity cost should be included in that.

Member Shiely said they arbitrarily picked one inch and that there may be
anecdotal evidence that wouldn’t support that empirical evidence
demonstrated by the property owner and that that should be accepted.

Member Shiely said that existing rights-of-way should be grandfathered in
prior to the adoption of these new rules.

Member Shiely said that they refer to violations in the rules but show no
appellate relief. He thinks there should be a way for applicants to have a
third party involved if there’s a disagreement.

Member Shiely commented on the time line of 90 days between the
application being filed and construction beginning. Member Willenbring
said that the owner or developer could take care of the applications during
the planning stage so it wouldn’t hold up the start of work. Member
Shiely said he didn’t see why the process couldn’t be done in 30 days.

Member Willenbring said they should probably move this topic to the next
meeting to give them all time to review the information. Duane Schwartz
said they could take additional comments at the beginning of the
November meeting.

7.November Agenda

Additional comments on Capital Region Watershed Rules
2006 Construction Work Plan for Public Works

Additional Comments:

Member Shiely read a letter he had written to the President of the
University of Minnesota thanking him for Mihai Marasteanu’s
participation in the Public Works Commission. Duane Schwartz relayed
comments from Chair Doug Wilke about the letter, that at the last meeting
they had decided not to send a letter. They will discuss this again at the
November meeting.

Member Shiely asked that he be included in the briefing of new member
Randy Neprash since he wasn’t given any briefing when he started.
