<br />Member Fischer commented on leak detection equipment that is provided <br />to gas station owners by the MPCA to monitor their gas tanks. He said the <br />MPCA has had some trouble monitoring the equipment. He suggested the <br />watershed may want to look into that situation to head off any problems. <br /> <br />Member Shiely commented on the economic impact amount used in the <br />presentation and said that the opportunity cost should be included in that. <br /> <br />Member Shiely said they arbitrarily picked one inch and that there may be <br />anecdotal evidence that wouldn't support that empirical evidence <br />demonstrated by the property owner and that that should be accepted. <br /> <br />Member Shiely said that existing rights-of-way should be grandfathered in <br />prior to the adoption of these new rules. <br /> <br />Member Shiely said that they refer to violations in the rules but show no <br />appellate relief. He thinks there should be a way for applicants to have a <br />third party involved if there's a disagreement. <br /> <br />Member Shiely commented on the time line of90 days between the <br />application being filed and construction beginning. Member Willenbring <br />said that the owner or developer could take care of the applications during <br />the planning stage so it wouldn't hold up the start of work. Member <br />Shiely said he didn't see why the process couldn't be done in 30 days. <br /> <br />Member Willenbring said they should probably move this topic to the next <br />meeting to give them all time to review the information. Duane Schwartz <br />said they could take additional comments at the beginning of the <br />November meeting. <br /> <br />7. November Agenda <br /> <br />Additional comments on Capital Region Watershed Rules <br />2006 Construction Work Plan for Public Works <br /> <br />Additional Comments: <br /> <br />Member Shiely read a letter he had written to the President of the <br />University of Minnesota thanking him for Mihai Marasteanu's <br />paliicipation in the Public Works Commission. Duane Schwartz relayed <br />comments from Chair Doug Wilke about the letter, that at the last meeting <br />they had decided not to send a letter. They will discuss this again at the <br />November meeting. <br /> <br />Member Shiely asked that he be included in the briefing of new member <br />Randy Neprash since he wasn't given any briefing when he started. <br /> <br />Page 3 of 4 <br />
