<br />Page 3 of 26 <br />Permit No: MNRIOOOOI <br /> <br />PART I. PERMIT COVERAGE AND LIMITATIONS <br /> <br />A. PERMIT COVERAGE <br /> <br />I. This permit is required for storm water discharges associated with construction activity and <br />with small construction activity as defined in 40 C.F.R. part 122.26(b)(14)(x) and (b)(15), <br />respectively. <br /> <br />2. This pennit authorizes, subject to the terms and conditions of this pennit, the discharge of storm <br />water associated with coustruction activity and small construction activity. <br /> <br />Construction activity includes clearing, grading and excavation, that disturbs land of equal to or <br />greater than five (5) acres and includes the disturbance ofless than five (5) acres of total land <br />area that is a part of a larger common plan of development or sale if the larger common plan <br />will ultimately disturb five (5) acres or more. <br /> <br />Small construction activity includes clearing, grading and excavation, that disturbs land of <br />equal to or greater than one (1) acre, and includes the disturbance ofless than one (1) acre of <br />total land area that is part of a larger common plan of development or sale if the larger <br />common plan will ultimately disturb equal to or greater than one and less than five (5) acres. <br />Small construction activity does not inclnde rontine maintenance that is performed to maintain <br />the original line and grade, hydraulic capacity, or original pnrpose of the facility. <br /> <br />3. This pemlit covers all areas of the state of Milll1esota. <br /> <br />4. For Parts LB through Appendix A of this pennit, all reference to construction activity includes <br />both small construction activity and construction activity. <br /> <br />B. LIMITATIONS OF COVERAGE <br /> <br />This permit does not cover the following activities: <br /> <br />I. Discharges or releases that are not storm water except those non-storm water discharges <br />authorized under Part IV.D. <br /> <br />2. The placement of fill into waters of the state requiring local, state, or federal authorizations <br />(such as U.S. Anny Corps of Engineers Section 404 pennits, Department of Natural Resources <br />Public Waters Work Pennits or Local Governmental Unit Wetland Conservation Act <br />replacement plans or detenninations). <br /> <br />3. Storm water discharges associated with industrial activity that originate from the site after <br />constrnction activities have been completed and the site has nndergone final stabilization. Post- <br />constrnction industrial storm water discharges may need to be covered by a separate <br />NPDES/SDS permit. <br /> <br />4. Non-point source agricultural and silvicultural discharges exclnded from NPDES pennit <br />requirements under 40 CFR part 122.3(e). <br /> <br />5.
