For projects under subpmt 3.a. of this palt, the Permittee(s) will receive a <br />pennit letter and certificate acknowledging permit coverage, usually within 30 days ofthe <br />postmarked date of the completed application. <br /> <br />5. Change of Coverage. For storm water dischm.ges from construction projects where the owner <br />or operator changes, (e.g., an original developer sells portions of the property to various <br />homebuilders) the new owner or operator must submit a subdivision registration within 7 days <br />of assuming operational control of the site, commencing work on their pOltion of the site, or of <br />the legal transfer, sale or closing on the property. For instances where an owner or operator of <br />an entire project changes after an application has been submitted under Part II, the new owner or <br />operator must submit an application for pennit transfer/modification within 7 days of assuming <br />control of the site or conmlencing work on-site, or of the legal transfer, sale or closing on the <br />propelty. Late submittals will not be rejected; however, the MPCA reserves the right to take <br />enforcement for any unpennitted discharges or permit noncompliance for the new registered <br />party that has assumed control ofthe site. For storm water discharges from construction <br />activities where the owner or operator changes, the new owner or operator can implement the <br />original SWPPP created for the project or develop and implement their own SWPPP. <br />Permittee(s) shall ensure either directly or through coordination with other Permittee(s) that <br />their SWPPP meets all tenns and conditions of this penn it and that their activities do not render <br />another party's erosion prevention and sediment control Best Management Practices <br />(BMPs)." <br /> <br />C. TERMINATION OF COVERAGE <br /> <br />I. Permittee(s) wishing to terminate coverage under this pennit must submit a Notice of <br />Termination (NOT) to the MPCA. Compliance with this permit is required until a NOT is <br />submitted. The Permittee(s) authorization to discharge under this permit terminates at midnight <br />of the day the NOT is signed. <br /> <br />2. All Permittee(s) must submit a NOT within thirty (30) days after one or more of the following <br />conditions have been met: <br /> <br />a. Final stabilization (see Part lV.G. and definition in Appendix B) has been achieved on all <br />portions of tile site for which the Permittee is responsible (including the removal of all <br />temporary measures such as silt fence, and if applicable, returning agricultural land to its pre- <br />construction agricultural use); <br /> <br />b. Another owner/operator (Permittee) has assumed control according to Part II.B.5 over all <br />areas ofthe site that have not been finally stabilized; or <br /> <br />c. For residential construction only, temporary erosion protection and down gradient <br />perimeter control for individual lots has been completed and the residence has been <br />transferred to the homeowner. Additionally, the Permittee must distribute tile MPCA's <br />"homeowner factsheet" to the homeowner to infonn the homeowner of tile need for, and <br />benefits of, final stabilization. <br /> <br />3. Permittee(s) that use an alternative method for the permanent storm water management system <br />as described in Part III.C.5, are prohibited from tenninating this pennit until final stabilization <br />has been achieved on site and either: <br /> <br />wq-strm2M51 <br />
