The cleanout of <br />pennanent basins mnst be sufficient to return the basin to design capacity. <br /> <br />2. For residential construction only, final stabilization has been achieved when temporary <br />erosion protection and down gradient perimeter control for individual lots has been completed <br />and the residence has been transferred to the homeowner. Additionally, the Permittee must <br />distribute the MPCA "homeowner factsheet" to the homeowner to infonn the homeowner of <br />the need for, and benefits of, final stabilization. <br /> <br />PART V. GENERAL PROVISIONS <br /> <br />A. APPLICABILITY CRITERIA <br /> <br />1. If the Commissioner determines that storm water discharges associated with a constrnction <br />activity are contributing to a violation of a water quality standard or would be more <br />appropriately regnlated by an individual permit, the Commissioner may require tbe owner to be <br />covered by an individual storm water discharge pennit. The Commissioner may require the <br />owner to develop and implement specific BMPs and monitor the discharge from the site. If <br />applicable, upon issuance of an individual pennit, this general permit would no longer apply. <br /> <br />2. If the terms and conditions of this general permit cannot be met, an owner may request an <br />individual permit, in accordance with Minn. R. 700 I. <br /> <br />B. RESPONSE <br /> <br />The SWPPP, including all certificates, reports, records, or other information required by this permit, <br />must be made available to federal, state, and local officials within 72 hours upon request for the <br />duration of the pennit and for three years following the NOT. This does not include any records <br />after submittal of the NOT. <br /> <br />C. PROHIBITIONS <br /> <br />This pennit prohibits discharges of any material other than storm water, and discharges from <br />dewatering or basin draining activities in accordance with Part IV.D.I and 2. For example, <br />prohibited discharges include but are not limited to vehicle and equipment washing, maintenance <br />spills, wash water, and discharges of oil and other hazardous substances. <br /> <br />D. TRANSFER OF OWNERSHIP OR CONTROL <br /> <br />This permit may not be assigned or transferred by the permit holder except when transfer occurs in <br />accordance with the applicable requirements of Part II.B.S. <br /> <br />E. CIVIL AND CRIMINAL LIABILITY <br /> <br />Nothing in this pennit mnst be construed to relieve the Permittee(s) from civil or criminal penalties <br />for noncompliance with the tenns and conditions provided herein. Nothing in this pennit must be <br />construed to preclude the initiation of any legal action or relieve the Permittee(s) from any <br />responsibilities, liabilities, or penalties to which the Permittee(s) is or may be subject to under <br />Section 311 of the Act and Minn.
