<br />Minnesota Statutes 2005, Chapter 18B. <br /> <br />Page 26 of 42 <br /> <br />Subd. 3. Pesticide Applicator Education and Examination <br />Review Board. (a) The commissioner shall establish and chair <br />a Pesticide Applicator Education and Examination Review Board. <br />This board, consisting of 15 members, must meet at least once a <br />year before the initiation of pesticide educational planning <br />programs. The purpose of the board is to discuss topics of <br />current concern that can be incorporated into pesticide <br />applicator training sessions and appropriate examinations. This <br />board shall review and evaluate the various educational programs <br />recently conducted and recommend options to increase overall <br />effectiveness. <br /> <br />(b) Membership on this board must include applicators <br />representing various licensing categories, such as agriculture, <br />turf and ornamental, aerial, aquatic, and structural pest <br />control and private pesticide applicators, and other <br />governmental agencies, including the University of Minnesota, <br />the Pollution Control Agency, Department of Health, Department <br />of Natural Resources, and Department of Transportation. <br /> <br />(c) Membership on the board must include representatives <br />from environmental protection organizations. <br /> <br />(d) This board shall review licensing and certification <br />requirements for private, commercial, and noncommercial <br />applicators. This board shall review category requirements and <br />provide recommendations to the commissioner. Requirement. (a) Except as provided <br />in paragraph (b), no fixed location may offer for sale or sell a <br />restricted use or bulk pesticide to a pesticide end user without <br />a pesticide dealer license. <br /> <br />(b) A pesticide dealer license is not required for: <br /> <br />(1) a licensed commercial applicator, noncommercial <br />applicator, or structural pest control applicator who uses <br />restricted use pesticides only as an integral part of a <br />pesticide application service; <br /> <br />(2) a federal, state, county, or municipal agency using <br />restricted use pesticides for its own programs; <br /> <br />(3) a licensed pharmacist, physician, dentist, or <br />veterinarian when administering or dispensing a restricted use <br />pesticide for use in the pharmacist's, physician's, dentist's, <br />or veterinarian's practice; or <br /> <br />(4) a person at a fixed location that is not used to offer <br />for sale or sell restricted use or bulk pesticides including, <br />but not limited to, warehouses or other storage sites. <br /> <br />http://www.revisor.leg.state.mn.uslbin/getpub.php?pubtype=ST A T _ CHAP&year=current... <br /> <br />4/21/2006 <br />
