Mr. Duane Schwartz
June 29, 2006
Page 3

where pesticides have been applied and at or near the entrances to the
property.

Due to the limited grant of authority to local governments to regulate in this area, the
City is restricted to enacting an ordinance limited to these signage requirements. And in fact,
the City may not provide for more restrictive pesticide signage requirements. Minn. Stat. S
18B.09, subd. 2. Any attempts by the City to further regulate pesticides would be preempted
by state law. The state broadly regulates pesticides and has only granted local governments the
limited authority to enact ordinances dealing with signage requirements.

If you have any further questions or concerns about this matter, please do not hesitate to
contact our office.

Very truly yours,

~9~

Jay T. Squires
Eric J. Quiring

cc: Mr. Neal Beets, City ofRoseville

RRM: #93166
