Variance Board Meeting <br />Minutes – Wednesday, October 04, 2006 <br />Page 2 <br />code-compliant; actual sales display parking area limit of thirteen (13) spaces; and distance <br />of parallel parking spaces (3 spots) to County Road C. <br />Staff recommended approval of the request, by adoption of a Variance Board Resolution <br />approving a fifteen foot (15’) variance OR 22’ variance to allow the continued use of a pre- <br />existing parking lot that lies within the newly established required front yard setback for <br />property at 1755 County Road C, based on the comments and findings of Section 5 and the <br />conditions of Section 6 of the project report dated October 4, 2006. <br />City Engineer Debra Bloom summarized her inspection of the site and confirmed staff’s <br />recommendation, noting that the proposal met minimum standards, and opining that the <br />reorganization of the site in the proposal actually was more attractive and created better <br />circulation of the site; further opined that she found no site issues with the flow and public <br />safety or the drive lane, sidewalk, relocation of the fencing, or proposed parking; and no <br />interference with the operation of the right-of-ways. <br />Applicant, Dave Ohrt, Cummings Mobility <br />Mr. Ohrt expressed his willingness to work with staff to discourage parking on the area <br />through installation of planters or some kind of device to prevent parking in the area of <br />concern. Mr. Ohrt’s preference would not be for removal of existing bituminous due to cost <br />factors. <br />Further discussion involved the inclusion of a provision to make it clear that no vehicles were <br />to be parked within nineteen feet (19’) of the sidewalk, and that some type of barrier needed <br />to be put in place to prevent exceptions. <br />Commissioner Boerigter was supportive of the request with the above-referenced condition; <br />encouraging the applicant to remove existing bituminous in that area as it deteriorated. <br />Commissioner Doherty expressed preference for removal of the pavement, but recognized <br />the difficulty in enforcing such a condition; and opined his support of the proposal conditioned <br />as referenced by Commissioner Boerigter. <br />No one appeared for or against the project at the hearing. Chair Bakeman closed the Public <br />Hearing. <br />MOTION – Resolution #2 at 22’ <br />Member Bakeman moved, seconded by Member Boerigter, to adopt Variance Board <br />Resolution No. 46 entitled, “A Resolution Approving a 22-Foot Variance to §1007.01 <br />(Minimal Industrial Area & Building Dimensional Requirements – Front yard Parking <br />Lot Setback) of the Roseville City Code for Cummings Mobility, 1755 County Road C <br />(PF 3767);” allowing the continued use of a pre-existing parking lot that lies within the <br />newly established required front yard setback for property at 1755 County Road C; <br />based on the comments and findings of Section 5 and the conditions of Section 6 of <br />the project report dated October 4, 2006; <br />amended as follows: <br /> <br />Condition 1: <br />The site and this applicant/use (Cummings Mobility) shall be limited to a front yard <br />vehicle sales/display area not exceeding fifteen (15) [ten (10)] vehicles. <br />Condition 5: <br />Eliminate existing language: “The variance (if granted) shall expire within six (6) <br />months of their approval if a sign permit is not issued for the respective site <br />pursuant to §1013.03 of the City Code.” <br />New Condition 5: <br /> Add new lan <br />guage: “No vehicles are to be parked within nineteen feet (19’) of the <br /> sidewalk along County Road C.
