Variance Board Meeting <br />Minutes – Wednesday, October 04, 2006 <br />Page 4 <br />requested Variance Board consideration of approval. <br />Discussion included patios, four-season porches, and/or decks; permeable versus non- <br />permeable materials and impacts; and dimensions of existing and proposed addition. <br />Ms. Bloom reviewed staff’s determination in using the as-built of the original development <br />and delineated boundaries in 1994; noted that staff was not privy to the information provided <br />to the Board as a bench handout by the applicant at tonight’s meeting; and reviewed the <br />various shapes and forms of wetlands (e.g., open water; emergent vegetation; non-emergent <br />vegetation; types of soil; and depth of water), not all of which are visible. <br />Chair Bakeman closed the Public Hearing. <br />Commissioner Doherty spoke in support of denying the request; opining that he took wetland <br />setbacks very seriously; and further opining that he would find it hard to deny other <br />neighborhood requests for a variance if this request were granted. <br />Commissioner Boerigter noted that he took wetland setbacks seriously as well; however, he <br />wanted to clarify that this was in actuality a wetland; and opined that the addition of a four- <br />season porch, as presented, may not have a huge impact on the existing wetland. <br />Commissioner Boerigter recognized Commissioner Doherty’s concerns, and what was <br />attempting to be accomplished with the wetland setback; and would adhere to Commissioner <br />consensus for denial. <br />Chair Bakeman spoke in support of denying the request, expressing her strong support of <br />wetlands and lakeshores. <br />Chair Bakeman closed the Public Hearing. <br />MOTION <br />Member Bakeman moved, seconded by Member Doherty, to Adopt Variance Board <br />Resolution No. 47, entitled, “A Resolution DENYING a 15 foot variance to §1016.16 <br />(Wetland Setbacks) of the Roseville City Code for Thomas McDaniel, 527 Owasso Hills <br />Drive (PF 3787);” DENYING a Variance to allow the construction of a residential <br />addition extending 15 feet closer to a wetland boundary than Code permits; as detailed <br />in the Staff Report dated October 4, 2006. <br />For staff’s reference, Commissioners concurred that staff’s hardship test related to the <br />existing home being larger than ninety-seven percent (97%) of the houses in the City, was <br />not an applicable test for granting or denying a variance. However, Commissioners concurred <br />that a reasonable use existing for the home; and protection of the fifty-foot (50’) setback for <br />wetland protection was certainly applicable. <br />Ayes: 3 <br />Nays: 0 <br />Motion carried/request DENIED. <br />Chair Bakeman advised the applicant of the appeal process timeframe. <br />5. Adjournment <br />Chair Bakeman adjourned the meeting at 6:34 p.m. <br />
