As explained in our June 29, 2006 letter, the state <br />has broadly regulated pesticides, and expressly preempts local governments from acting in <br />this area unless specifically granted authority. <br />The one area in which cities are granted authority to regulate pesticides is in the <br />area of warning signs. The rules are spelled out in the 6/29 letter. All other issues, <br />such as licensing applicators, would be preempted by the state. <br />Second, the phrase "at or near the entrances to the property II could be clarified to <br />provide a more specific rule. For example, we discussed the possibility of a definition <br />limited to entrances adjoining public rights of way. <br />If you need any additional assistance, please let me know. <br /> <br />ERIC J.
