ORDINANCE NO. 1347 AN ORDINANCE AMENDING TITLE 10, CHAPTER 1014, SECTION 1014.04C PERTAINING TO THE BOARD OF ADJUSTMENT AND APPEALS THE CITY OF ROSEVILLE ORDAINS: SECTION 1. Purpose. The Roseville City Code, Tile 10, Chapter 1014 (Board of Zoning Adjustments & Appeals) is hereby amended by eliminating, clarifying and revising language contained within Section 1014. The purpose of this Ordinance is to create language that provides ample notification to residents and clarifies the process by which an appeal is heard by the City Council. SECTION 2. Section 1014.04 is hereby amended to read as follows: Section 1014.04(C)(2) of the City Code shall read: The written appeal shall state the specific grounds upon which the appeal is made and shall be accompanied by a fee established by resolution of the city council. A public meeting regarding the matter shall be held before the Board of Adjustment and Appeal at a regular meeting held within 30 days of the receipt of the required written appeal. A mailed notice of the public meeting at which the appeal is to be considered shall be sent to members of the Variance Board (if applicable) and to all of those property owners within 350 feet of the subject property as well as the owner and tenants (if any) of the subject property. Section 1014.04(C) of the City Code shall be added, stating: The Board of Adjustments and Appeals will reconsider only the evidence that had previously been considered as part of the formal action that is the subject of the appeal. New or additional information from the appeals applicant maybe considered by the Board of Adjustments and Appeals at its sole discretion, if that information serves to clarify information previously considered by the Variance Board and/or staff. SECTION 3. Effective Date. This ordinance amendment to the Roseville City Code shall take effect upon passage and publication. Passed this 23rd day of April, 2007
