Regular City Council Meeting <br />Monday, June 18, 2007 <br />Page 30 <br />the City take the more conservative approach with it not being appli- <br />cable. <br />Additional discussion included potential litigation from this developer <br />and whether they were agreeable to correspond timing of their appli- <br />cation with completion of the AUAR update; with no commitment <br />from the applicant to agree to such provisions, essentially solving the <br />above-referenced issues. <br />Further discussion included contamination of the overall redevelop- <br />ment area, and lack of information on the degree of potential contami- <br />nation on this site; need for applicant to comply with proto-typical de- <br />signs for the hotel and restaurant users proposed for the site, and <br />staff's general and overall acceptance of design issues with minor re- <br />vision; with previous discussions on staffls preference for massing <br />buildings on Cleveland Avenue and reducing density toward Langton <br />Lake as advocated in the Twin Lakes Master Plan. <br />Councilmember Ihlan expressed frustration that an open call for inter- <br />ested master developers could not be pursued to avoid piecemeal de- <br />velopment of the area and provide community-based planning. <br />Mr. Stark shared Councilmember Ihlan's frustrations with single site <br />development in a master plan area; and recognized that the applicant <br />shared that frustration as well. However, Mr. Stark reiterated staff's <br />analysis and recommendation that, with enough negatives and un- <br />knowns with this application as presented, they were recommending <br />denial. <br />John Livingston, Hotel/Restaurant Applicant, 2700 Cleveland <br />Avenue <br />Mr. Livingston read a prepared statement (no copy available), and. a <br />"Narrative in Support of the Rezoning and Concept Planned Unit De- <br />velopment Application," prepared by the applicant, Cent Venture Inc. <br />and AmWest Development LLC with Mr. Livingston as the contact <br />for property located at 2700 Cleveland Avenue, and dated April 2007 <br />and prepared by Midwest Planning & Design LLC, was included as <br />part of the staff report dated June 18, 2007. <br />
