Variance Board Meeting <br />Minutes – Wednesday, June 06, 2007 <br />Page 2 <br /> <br />Discussion included clarifying when the neighbor’s basketball court, fencing and <br />netting had been installed (summer of 2006); impervious surface excesses of the <br />basketball court defined as “playground equipment,” with no permit necessary; <br />drainage concerns; and installation of a curb along adjoining property lines to correct <br />runoff concerns. <br /> <br />It was the consensus of the Variance Board members that staff provide opportunity for <br />review by the Planning Commission in the future for permitting requirements relative <br />to impervious surface restrictions and calculations. <br /> <br />Acting Chair Boerigter closed the Public Hearing, with no one appearing for or <br />against. <br /> <br />Commissioner Doherty spoke in support of a fence, even though not a proponent of <br />tall fences, if for no other reason that aesthetics and visual impacts to the Hornbaker’s <br />side yard with the adjoining fence and netting. <br /> <br />The applicant, Mrs. Hornbaker, noted that the basketball hoop was located on the side <br />of the court, rather than the end of the court, thus exasperating the problem of balls <br />coming over the net into their yard. <br /> <br />Acting Chair Boerigter spoke in support of the application as well, opining that it was <br />unfortunate that the adjacent property owner hadn’t attempted to resolve the situation <br />on their own. <br /> <br />Commissioner Martinson concurred with Commissioners Doherty and Boerigter. <br /> <br />MOTION <br />Member Doherty moved, seconded by Member Boerigter to adopt Variance <br />Board Resolution No. 60 entitled, “A Resolution APPROVING VARIANCES to <br />Section 1012 (General Requirements) of the Roseville City Code for Ronald and <br />Susan Hornbaker, 2994 Aldine Street (PF 07-025); allowing for a 1.5-foot <br />VARIANCE TO Section 1012.02B(3) Side Yard Encroachments) and a 4-foot <br />VARIANCE to Section 1012.02B(2) (Front Yard Encroachments), based on the <br />comments and findings outlined in Section 5, and detailed conditions of Section <br />6 of the staff report dated June 6, 2007. <br /> <br />Ayes: 3 <br />Nays: 0 <br />Motion carried. <br /> <br />Acting Chair Boerigter advised the applicant of the appeal process timeframe. <br /> <br />5. Adjournment <br />Acting Chair Boerigter adjourned the meeting at 5:44 p.m. <br />
