Councilmember <br />Ihlan opined that this was not a good settlement for the City, who <br />would be essentially be giving up monies that the developer had <br />agreed to pay, in addition to unspecified future risks, Councilmember <br />Ihlan further opined that the City should take no further action until an <br />independent legal counsel were sought. <br />Councilmember Ihlan further opined that she was against this settle- <br />ment; that it would call for public accountability for taxpayer respon- <br />sibility; and these consequences fell on Mayor Klausing and Coun- <br />cilmembers who voted on issues from the beginning of the project <br />when there was pending litigation and no protection to the City, in ad- <br />dition to the Council majority who authorized Quick Take eminent <br />domain action and put the City at risk. <br />Councilmember Ihlan requested that actual Court Orders be made <br />public on the City's website and available for public review and un- <br />derstanding. <br />Councilmember Kough spoke in opposition to the motion; noting his <br />minority opposition position throughout the eminent domain process; <br />and opined that the redeveloper needed to take responsibility, as per <br />the contract and through the City recovering funds through the Letter <br />of Credit. Councilmember Kough recognized the requirement for the <br />City to pay the redeveloper $827,650 in accordance with the Court <br />Order; however, was not willing to pay any additional funds, with ad- <br />ditional attorney fees still pending. <br />Councilmember Roe concurred with Councilmember Ihlan's concerns <br />about a settlement not allowing for the most optimistic outcome for <br />the City. However, Councilmember Roe opined that this represented <br />the best route to pursue, given recent court rulings, and under present <br />circumstances. Councilmember Roe opined that, while this may not <br />be a great deal, there didn't appear any obvious alternatives that <br />would provide a better settlement for the City; and it would be better <br />to get something rather than nothing, or much less.
