EXTRACT OF MINUTES OF MEETING OF CITY COUNCIL OF CITY OF ROSEVILLE R:AIVISEY COUNTY, MINNESOTA Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, Minnesota, was held in the City Hall. in said City on Monday, August 13, 2007 at 6:00 o'clock p.m. The following members were present: Ihlan, Pust, Kough, Roe and Klausing and the following were absent: none Councilmember Roe introduced the following resolution and moved its adoption: RESOLUTION 10536 RESOLUTION APPROVING A LIMITED USE PERMIT WITH THE STATE OF MINNESOTA DEPARTMENT OF TRANSPORTATION FOR THE COUNTY ROAD C STREETSCAPE IMPROVEMENTS IN THE RIGHT-OF- TAY OF INTERSTATE 35W AT COUNTY ROAD C WHEREAS, the City of Roseville, Minnesota, is a political subdivision, organized and existing under the laws of the State of Minnesota; and, AND WHEREAS, the City Council of the City of Roseville has approved a plan to construct a streetscape project along County Road C from Long Lake Road to Oxford Street; AND WHEREAS, County Road C intersects Interstate 35W right-of--way; AND WHEREAS, the State of Minnesota, Department of Transportation requires a Limited Use Permit in order to construct, operate, and maintain the streetscape improvements including sidewalk and landscaping; THEREFORE BE IT RESOLVED that the City Council of the City of Roseville, Minnesota, hereby enters into a Limited Use Permit with the State of Minnesota Department of Transportation for the following purposes: To construct, operate, and maintain the streetscape improvements including sidewalk and landscaping within the right- of- way of Interstate 3 5 W along County Road C. The City of Roseville shall construct, operate, and maintain the streetscape improvements including sidewalk and landscaping in accordance with the Limited Use Permit granted by the Minnesota Department of Transportation. NOW, THEREFORE, BE IT FURTHER RESOLVED, that the City Council and the Mayor are authorized to execute the Limited Use Permit and any amendments to the permit. The motion for the adoption of the foregoing resolution was duly seconded by Member Pust upon a vote being taken thereon, the following voted in favor thereof: Ihlan, Pust, Kough, Roe and Klausing and the following voted against the same: none WHEREUPON said resolution was declared duly passed and adopted.
