S EET C C IJ CIL OF THE CI OF ROSEILLE Pursuant to due call and notice thereof, a regular meeting of the City Council of the City of Roseville, County of Ramsey, Minnesota, was held on the 23rd day of July, 2007 at 6:00 p.m. The following members were present: Pust, Roe, Ihlan, Kough, and Mayor Klausing and the following were absent: None Council Member Pust introduced the following resolution and moved its adoption: ESOLUTIN NO. 10525 A RESOLUTION APPROVING THE VACATION OF CERTAIN PUBLIC EASEMENTS ON PROPERTY LOCATED AT 2335, 2355, 2361 WEST HIGHWAY 36, BONESTROO (PF07-27} WHEREAS, Bonten LP and Bonten II, LLC has requested the VACATION of CERTAIN PUBLIC EASEMENTS that lie on their property; and WHEREAS, Bonten LP and Bonten II, LLC is located at 2335, 2355, and 2361 West Highway 36; and WHEREAS, the Public Works Department has determined that the existing easements will no longer be effective based on the approved storm water management pond redesign and therefore unnecessary in their current configuration/description; and WHEREAS, the Roseville Planning Commission held a public hearing regarding the EASEMENT VACATION request and voted (6-0) to recommend approval of vacating certain easements based on the information contained in Section 4 and 5 and the condition of Section 7 of the project report dated July 11, 2007. NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to grant the VACATION of certain PUBLIC EASEMENTS on property addressed at 2335, 2355, and 2361 West Highway 36, based on the information contained in Section 4 and 5 of the project report dated July 23, 2007, and subject to the following conditions: 1. Verification that condition number 3 of the Easement and Vacation Agreement has been completed to the satisfaction of the Public Works Director. 2. The provision of utility and drainage easements (on the final plat -Bonten Addition) for the newly configured storm water pond as required/approved by the Public Works Director.
