Minutes of 8/27/07 <br />Regular City Council Meeting <br />Page 15 <br />Councilmember Pust clarified Mr. Thatcher's allegations that the soil <br />borings weren't done exactly where they needed to be done. <br />Mr. Darrow reiterated that the developer would need to comply with <br />all necessary permitting, including the MPCA. City Attorney Ander- <br />son concurred, noting that while the MPCA wasn't going to review <br />something they didn't require, he noted the City's own engineering <br />report requiring MPCA certification. <br />Public Comment <br />Paul Romanowski, 2195 Acorn Road <br />Mr. Romanowski opined that he observed when the soil borings were <br />done and they were 200' from the current driveway and were nowhere <br />near proposed drainage plans. <br />Councilmember Roe sought staff assurance that the applicant would <br />be required to provide soil borings in the appropriate area. <br />Mr. Schultz advised that while no final plans have been provided for <br />the drainage, staff would assure that during their review those plans <br />met City Code and MPCA requirements. <br />Councilmember Pust sought staff assurance that the soil borings <br />would be done where they were supposed to be done. <br />Mr. Schwartz responded affirmatively. <br />Roe moved, Pust seconded, approval of the Final Plat of Oak Acres <br />and the Public Improvement Contract, allowing the creation of four <br />(4) single-family residential lots over 1.89 acres, including a public <br />road and utilities (sanitary sewer and water) from the parcel addressed <br />as 2001 Acorn Road, based on the comments of Section 4 and condi- <br />tions of Section 5 of the project report dated August 27, 2007. <br />Councilmember Roe spoke in support of the motion; and expressed <br />his understanding of the frustration of some neighbors that it may look <br />like some of the plans didn't meet City Code. Councilmember Roe <br />opined that the Council was considering approval of the Final Plat, or <br />drawing; and that the public improvement contract outlined obliga- <br />
