Variance Board Meeting <br />Minutes – Wednesday, August 01, 2007 <br />Page 3 <br /> <br />Associate Planner Bryan Lloyd reviewed the request of Mr. Kempton for variances to <br />allow construction of a new, larger detached garage that would encroach two feet (2’) <br />into the required five foot (5’) side yard setback. <br />Mr. Lloyd advised that Mr. Kempton originally thought that the proposed garage would <br />require a variance to the impervious coverage limits in the City Code, as reflected in <br />the applicant’s narrative (Attachment D). However, after reviewing the proposal, staff <br />determined that the proposal would not, in fact, exceed the allowable impervious <br />surface area, but would instead need a variance to the required building setback from <br />a wetland. <br /> VARIANCES to Roseville City <br />Staff recommended APPROVAL of the requested <br />Code,§1004 (Residential Districts) and §1016 (Wetlands) <br /> (2’ VARIANCE to the <br />side yard setback requirement established in Section 1004.016 and a 23’ VARIANCE <br />to the wetland setback required in Section 1016.16A); to allow construction of the <br />proposed garage based on the comments and findings outlined in Section 5, and <br />detailed conditions of Section 6 of the project report dated August 1, 2007. <br />Discussion included clarifying the two foot (2’) side yard setback and twenty-three foot <br />(23’) wetland setback; administrative setback variance permits for those determined to <br />be of a low impact nature, the public notification and process of twelve (12) criteria, <br />with a minimum of eight (8) required to be met, if not otherwise compromising general <br />health, safety and welfare rather than coming to a formal Variance Board hearing; and <br />the City Engineer’s review and approval of the proposed wetland boundaries and her <br />determination that no additional mitigation was required for runoff. <br />Staff clarified that the wetland was not originally delineated prior to 2003 City records, <br />at which time the boundary was delineated. <br />Additional discussion included staff’s previous recommended denial of a request by <br />the applicant in October of 2006, with staff unable to determine a hardship at that <br />time. Staff noted that now the situation was different in that the wetland setback <br />ordinance was adopted in 1994, long after the property was improved in 1956; and <br />because the setback line from the wetland boundary extends nearly to the front of the <br />existing garage, and no reconstruction or replacement of that building would be <br />possible without a variance. <br />Staff further clarified that the City’s Engineer was the administrator of the City’s <br />wetlands, and had reviewed and concurred with staff’s recommendation. <br />Applicant, Brian Kempton, <br /> was present but had no comment. <br />Commissioner Martinson noted that the existing storage shed was intended to be <br />removed. <br />Mr. Lloyd noted that the proposed garage would be covering the current storage site, <br />and was indeed intended for removal. <br />Vice Chair Doherty closed the Public Hearing, with no one appearing for or against. <br />MOTION <br /> <br />Member Martinson moved, seconded by Member Doherty to adopt Variance <br />Board Resolution No. 67 entitled, “A Resolution APPROVING VARIANCES to <br />Roseville City Code,§1004 (Residential Districts) and §1016 (Wetlands) for <br /> <br />Brian Kempton, 2619 Wheeler Street (PF07-044);” (2’ VARIANCE to the side yard <br />setback requirement established in Section 1004.016 and a 23’ VARIANCE to the <br />wetland setback required in Section 1016.16A); based on the comments and <br />findings outlined in Section 5, and detailed conditions of Section 6 of the <br />project report dated August 1, 2007 as presented. <br /> <br />
