Establish a Public Baring to Consider the Extension of Tax Increment Fi- <br />nancing District #1 -Centre Pointe (®FF CONSENT) <br />City Manager Malinen clarified for Councilmembers that this request for Council <br />action was only to schedule a Public Hearing to consider extension of the District, <br />allowing for receiving testimony; and noted that- this was essentially the last meet- <br />ing for scheduling the hearing, in order to provide required notice and schedule <br />the Public Hearing at the December 17, 2007 meeting. <br />Councilmember Ihlan opined that she had no problem setting the public hearing <br />date; however, she noted that the staff report indicated authorization for legal <br />analysis of $15,000 - $20,000; and she preferred the opportunity for City Council <br />discussion prior to that authorization and making such a commitment. <br />Mayor Klausing advised that he had similar concerns; and sought staff comment <br />on the cost and how such an analysis moved the process forward. <br />Finance Director Chris Miller advised that there were a number of legal filings <br />required under State Statute; a modification of the TIF Plan itself; and due dili- <br />gence to outline financial impacts on the City, and other jurisdictions (School Dis- <br />trict, Ramsey County and the Metropolitan Council) resulting if the district is not <br />decertified at the end of 2007. Mr. Miller noted that, while some of the work may <br />be done in-house, the compressed timeframe would indicate the need for outside <br />assistance, given the City Council calendar. Mr. Miller advised that staff could <br />return with additional and more firm costs at the November 5, 2007 Council meet- <br />ing; however, requested Council action tonight on scheduling the Public Hearing <br />due to the sense of urgency and formal action required. Mr. Miller further ad- <br />vised that his intent in including information on costs to be incurred was simply to <br />alert the City Council that there would be costs associated with consideration of <br />the decertification. <br />Councilmember Roe clarified that costs incurred would be paid out of that dis- <br />trict's TIF revenue, which was a positive revenue at this time, and further clarified <br />that the district currently had no contractual obligations. <br />
