City Council Meeting <br />November 26, 2007 <br />Councilmember Ihlan questioned the notice process when this item was heard at <br />the Planning Commission Public Hearing; since only one (1) resident had made <br />public comment. <br />Ms. Radel advised that standard hearing procedure was followed for published <br />notice of public hearing for a proposed zoning amendment. <br />Councilmember Ihlan opined that this was an important policy discussion, and <br />further opined that the public needed to know those proposed land use applica- <br />tions in the overlay district, implications, and those people potentially affected. <br />Councilmember Ihlan opined that recommendation was for creation of a new zon- <br />ing district in the charts, with new dimensional requirements. <br />Councilmember Pust again asked that staff clarify if the proposed overlay district <br />and language was changing anything that couldn't already be done by a property <br />owner. <br />Ms. Radel again clarified that the proposed overlay district simply more clearly- <br />defined pre-1959 platted land categories; and noted that the City's current ordi- <br />nance was prevent "McMansion" issues, due to the limited 30% impervious sur- <br />face coverage provisions. <br />City Attorney Scott Anderson addressed provisions of Chapter 1002, Rules and <br />Definitions (Section 1002.02) defining pertinent lot sizes; as well as Chapter <br />1012, Nonconforming Uses, addressing lot area and setback requirements; and <br />spoke in support of staff's interpretation of current and proposed clarified lan- <br />guage. <br />Councilmember Ihlan reiterated her concerns; opining that if the City Council was <br />going to pass these amendments, she wanted to hear some policy arguments; and <br />further opined that Councilmembers needed to be on the record as to their ration- <br />ale in making such decisions; opining that this was "in the direct opposite direc- <br />tion of the moratorium." <br />Mayor Klausing alerted staff to a potential technical error on page 45, Section <br />1005.07, and lettering for the mixed business park section; as well as today's date <br />on the draft, that would need to be changed for future action and potential adop- <br />tion. <br />Ms. Radel thanked Mayor Klausing for catching those items, and noted a sus- <br />pected word processing glitch; and advised that staff would double check the <br />numbering and lettering. <br />Councilmember Roe spoke to the suggested notion of attempting to squeeze in <br />smaller lots; and opined, based on the proposed language, staff recommendations, <br />
