WHEREAS, The Roseville Planning Commission held the public hearing regarding the PetSmart request on December 5, 2007, recommending (7-0) approval of the AMENDED CONDITIONAL USE PERMIT, subject to conditions; and WHEREAS, the Roseville City Council on January 14, 2008 approved a Zoning Text Amendment allowing pet boarding and/or dog day care as a conditional use in zones where pet and pet supply store were permissible; NOW THEREFORE BE TT RESOLVED, by the Roseville City Council, to APPROVE the request by PetSmart (in cooperation with Rosedale Commons LP, property owner) for a CONDITIONAL .USE PERMIT in accordance with Section 1013.01 of the Roseville City Code, subject to the following conditions; 1. Pet boarding within PetHotel shall be limited to accommodations for 108 dog kennels and 15 cat kennels within a 5,012 (+/-) sq. ft. fully enclosed indoor facility. 2. There shall be no after-hours pick-up. Delivery of pets for boarding, dog day care/camp and/or pet grooming (pet services) shall not occur before 7:00 a.m. Hours of operation shall be limited to 9:00 a.m. to 9:00 p.m. Monday through Saturday and 10:00 a.m. to 6:00 p.m. Sunday. Pet pick-up shall occur during specifically designated daily hours of operation. 3. Dog Day Camp (daytime boarding) shall be limited to 70 dogs. 4. No outdoor pet exercising/activity shall be allowed. 5. The tenant space shall be constructed and/or improved in a manner that does not cause nuisances outside of the premises and which meets the City's noise ordinance. 6. Pet waste will be handled in compliance with applicable building and/or health code requirements. The motion for the adoption of the foregoing resolution was duly seconded by Council Member Roe and upon vote being taken thereon, the following voted in favor: Pust, Roe , Kough, Ihlan, and Mayor Klausing and the following voted against: None WHEREUPON said resolution was declared duly passed and adopted. 2
