Regular City Council Meeting <br />Monday, January 28, 2008 <br />Page 26 <br />Roe moved, Ihlan seconded, adoption of Resolution No. 10591 entitled, "A Reso- <br />lution Approving a Planned Unit Development Amendment in accordance with <br />Roseville City Code, Sections 1006 and 1008, for Har Mar Mall, 2100 Snelling <br />Avenue (PF07-053);" with revised draft resolution language, page 2, line 10 - 15, <br />revised, and mirroring that requested by the applicant, to read as follows: "While <br />not requiring closure of this ingress/egress as a part of the approval of the PUD <br />Amendment, the parties acknowledge that the City does not waive, and hereby re- <br />tains, any right which it may have under applicable law to require closure of the <br />ingress and/or egress from such westerly driveway in the future should the City <br />determine, in its reasonable discretion, that traffic safety considerations warrant <br />it." <br />Councilmember Pust sought staff comment on proposed revised language; and <br />impacts to their concerns for the right-in/right-out access, specific to supplemental <br />information detailed in the staff report, Section 9.2. <br />City Engineer Deb Bloom advised Councilmembers that staff's concerns re- <br />mained on record, and had not changed, noting that their further review had led to <br />their recommendation that, at a minimum, elimination of the eastbound exiting <br />movement remain as a condition. Ms. Bloom confirmed that staff remained con- <br />sistent in their safety concerns. <br />Ayes: Roe; Ihlan; and Klausing. <br />Nays: Pust. <br />Motion carried. <br />Roll Call <br />d. Consider Request by Emmes Realty Services LLC for an Amended Planned <br />Unit Development at Har Mar Mall, 2100 Snelling Avenue (Backyard Grill) <br />(PF07-062) <br />City Planner Thomas Paschke briefly reviewed the requested action for the appli- <br />cant's redevelopment of the former Backyard Grill into another sit-down restau- <br />rant. <br />Councilmember Ihlan thanked staff for their revisions as requested by the City <br />Council at their previous meeting; however, opined that she still had qualms on <br />this piece, given the lack of an actual site plan. Councilmember Ihlan expressed <br />concern that public comment would not be available as final site plans were de- <br />veloped and approved at the staff level. <br />Discussion ensued regarding public participation; the public hearing process to <br />receive public comment; current code requirements encapsulating and protecting <br />public concerns through the design of building elevations and placement of the <br />proposed building. <br />
