WHEREAS, the property owner seeks to create two lots that are 7,700 square feet in area <br />(Parcel A) and 8,200 square feet in area(Parcel B), requiring variances of 3,300 square feet and <br />2,800 square feet, respectively; and <br />WHEREAS, Section 1004.016 (Residential Setbacks) requires a principal structure <br />setback of 10 feet from the side property line of proposed Parcel B; and <br />WHEREAS, the existing principal structure is setback 3 feet from the side property line, <br />requiring a 7-foot variance; and <br />WHEREAS, The Roseville Planning Commission held a public hearing regarding the <br />requested VARIANCES, concluded that "hardships" are present, and voted 7-0 to recommend <br />approval of the request based on the comments, findings, and conditions of the staff report dated <br />November 7, 2007; and <br />WHEREAS, the Roseville City Council concurs with the Planning Commission <br />conclusion pertaining to "hardships" and has determined that approval of the requested <br />VARIANCES will not compromise the public health, safety, and general welfare of the citizens <br />of Roseville; <br />NOW THEREFORE BE IT RESOLVED, by the Roseville City Council, to APPROVE <br />the requested VARIANCES to Section 1004.016 of the City Code, subject to the following <br />conditions: <br />1. Proposed Parcel A shall not have a buildable area of less than 7,700 square feet; <br />2. Proposed Parcel A shall not have a depth of less than 128 as measured from the <br />Dale Street right-of--way; <br />3. Proposed Parcel B shall not have a buildable area of less than 8,200 square feet; <br />4. If the existing house on Parcel B is demolished in the future, any redevelopment <br />of the property shall comply with the requirements of the City Code at that time; <br />and <br />5. The VARIANCES shall expire six months after the City Council approval date if <br />the applicant has not recorded the legal descriptions of the new parcels by that <br />time, pursuant to § 1013.03 of the City Code. <br />The motion for the adoption of the foregoing resolution was duly seconded by Council <br />Member Klausing and upon vote being taken thereon, the following voted in favor: Roe, Pust, <br />Kough and Mayor Klausing <br />and Member Ihlan voted against; <br />WHEREUPON said resolution was declared duly passed and adopted. <br />Page 2 of 3 <br />
