The IUP shall be limited to the tenant space addressed as 2581 Fairview Avenue. <br />Should Mr. Theobald desire w expand into other vacated tenant spaces, an <br />amendment to this PERMIT would be necessary. <br />2. The IUP shall be allowed for a period of 5 years (August 13, 2007 to August 13, <br />2012) mrless an extension is requested by Mark Theobald and/or ERP Minnesota <br />Portfolio, LLC three months prior to the above expiration date (May 13, 2012). <br />3. City Staff to review whether ADA and Clean Air Act requirements are met prior <br />to the issuance of a Certificate of Occupancy. <br />The motion for the adoption denial of the foregoing resolution was duly seconded by <br />Council Member Pust and upon vote being taken thereon, the following voted in favor: Ihlan, <br />Pust, Kough, Roe, and Mayor Klausing <br />and the following voted against: Noue <br />WHEREUPON said resolution was declared duly denied/passed and adopted. <br />2 <br />
