If <br />633 I this Section 0101.8) imposes a requirement different from other sections of the city code, the <br />634 more restrictive section shall apply. <br />635 ~ '101.8.02: SCOPE: <br />636 Except as exempted by the definition of the term "land disturbance activity" in Section <br />637 ~ r r~ 1.018.03, any person, state agency, or political subdivision thereof proposing land <br />638 disturbance activity within the City shall apply to the City for the approval of the erosion and <br />639 sediment control plan. No land shall be disturbed until the plan is approved by the City and <br />640 conforms to the standards set forth in this article. <br />641 ~ ~~-Q-I~101.8.03: DEFINITIONS: <br />642 EROSION AND SEDIMENT CONTROL PLAN means a document containing the requirements <br />643 ~ of Section -1{~-1-71 ()18.04 that, when implemented, will prevent or minimize soil erosion on a <br />644 parcel of land and off-site sediment damages. <br />645 I '1.018.04: STORM WATER MANUAL: EROSION AND SEDIMENT <br />646 CONTROL PLAN: <br />647 X1018.05: REVIEW OF PLAN: <br />648 ~-0~-'1.018.06: IMPLEMENTATION AND MAINTENANCE OF PLAN: <br />649 ~ ~-'1018.07: MODIFICATION OF PLAN: <br />650 An approved erosion and sediment control plan may be modified on submission of an application <br />651 for modification to the City and subsequent approval by the City Engineer. In reviewing such <br />652 application, the City Engineer may require additional reports and data. <br />653 ~ -41.018.08: ESCROW REQUIREMENT: <br />654 After approval of an erosion and sediment control plan, the City shall require the Permittee to <br />655 escrow a sum of money sufficient to ensure the installation, completion, and maintenance of the <br />656 erosion and sediment control plan and practices. Escrow amounts shall be set from time to time <br />657 by the City Council. Upon project completion, the remaining escrow shall be returned to the <br />658 Permittee. <br />659 ~ ~1-'1.01. $.09: EROSION AND SEDIMENT CONTROL PERMIT <br />66o ENFORCEMENT: <br />661 D. Failure to Do Corrective Work. When a Permittee fails to conform to any provision of this <br />662 policy within the time stipulated, the City may take the following actions: <br />663 4. All costs incurred by the City in correcting erosion and sediment control deficiencies shall <br />664 be reimbursed by the Permittee. If payment is not made within thirty (30) days after costs <br />665 are incurred by the City, payment will be made from the Permittee's financial securities, as <br />666 ~ described in Section ~-E}mil f)1.8.08 of this Ordinance. <br />667 5. If there is an insufficient financial amount in the Permittee's financial securities as <br />668 ~ described in Section -lf)}101.8.08 of this Ordinance to cover the costs incurred by the City <br />669 then the City may assess the remaining amount against the property.
