2. The sit-down restaurant structure shall be placed within a flexible building pad <br />(trapezoidal in shape) and include the following setbacks: a minimum of 30 feet <br />from the Snelling Avenue (west) property line and a minimum of 50 feet from the <br />south property line. The minimum setback from the Mall access drive lane shall <br />be 15 feet. <br />3. The exterior building materials for new sit-down restaurant shall be consistent <br />with Section 1010 (Design Standards) of the Roseville City Code, including brick, <br />stone, EFIS, glass or prefinished architectural metal. <br />4. The maximum building height shall not exceed 35 feet. <br />5. All requirements pertaining to mechanical units, trash enclosures, lighting, and <br />maintenance activity shall meet the requirements specified in Section 1006.05 <br />and/or 1010 of the Roseville City Code. <br />6. A fence board-on-board screen shall be installed along the south property line, <br />which location shall be reviewed and approved by the Planning Division, and <br />which shall preserve existing mature trees/landscape. The fence shall be placed <br />within the buffer strip in a manner that supports the addition of landscape to <br />enhance the area. <br />7. Should the final tenant desire a outdoor seating/patio area, that area shall be <br />placed along the west, north, or east side of the new restaurant structure nearest <br />the Mall access drive and separated by a 10 to 20 foot landscaped buffer. <br />8. A pedestrian and bicycle access plan shall be submitted for review and approval <br />by the City Engineer prior to the issuance of a building permit. <br />9. Har Mar is the only property served by the easterly leg of Snelling/Skillman <br />Avenue intersection and receives a direct benefit by its safe and efficient <br />operation. As a result the MALL ownership shall pay, as an assessment, 50% of <br />the City's cost participation in the Skillman/Snelling Avenue 2008 MnDOT signal <br />replacement project, in an amount not to exceed $30,000. <br />10. Prior to review by the Development Review Committee (DRC) and prior to the <br />issuance of any building permits, those specific plans for the redevelopment of the <br />Backyard Grill area, adjacent property owners -specifically those residential areas <br />to the south previously noticed for Public Hearing purposes related to PF07-062 - <br />will be provided an opportunity for review and comment of those redevelopment <br />plans. This does not constitute another Public Hearing, but serves as a public <br />informational meeting for the benefit of those residential property owners; with <br />residents encouraged to comment by e-mail, phone or in person with staff; with <br />those comments forward to the DRC for their consideration in reviewing the final <br />plans. <br />Page 2 of 4 <br />
