Mr. Lloyd further advised that the B-1B District also allowed catering facilities with <br />a CUP. Mr. Lloyd noted that there was no specific definition of “deli” in the City’s Zoning Ordinance; and <br />provided staff’s interpretation of that language. <br />Mr. Lloyd reviewed staff’s report in detail, and those CUP criteria in reaching a recommendation. Mr. <br />Lloyd noted that it was staff’s opinion that traffic impact from the proposed use would be negligible, given <br />existing traffic on Lexington Avenue from current uses. <br />Staff recommended APPROVAL of the REZONING REQUEST and APPROVAL of the CONDITIONAL <br />USE PERMIT (CUP), based on the comments and findings detailed in Sections 5, 6, and 7, and <br />conditions detailed in Section 8 of the staff report dated December 5, 2007; and that prior to <br />occupation, the applicant remove parking areas along Autumn Street, in accordance with City <br />Council Resolution 89-14, as an existing requirement based on staff research and findings. <br />Discussion included potential location of a window (on the north side of the parking lot) for pick up orders; <br />clarification that no outdoor menus or audio equipment would be included as part of the application; <br />prohibition of a drive-thru facility and/or equipment; City Code provisions for this type of fast food, with <br />staff opining that City Code guidelines appeared to be high; staff’s support for rezoning from B-1 to B-1B; <br />definition of restaurant types and uses as per City Code; possibility for a future user to raze this building <br />and implement a fast food restaurant; and parking limitations and self-regulation on potential uses. <br />Commissioner Doherty expressed concern, not with this applicant, but with long-term CUP implications <br />for a potentially different type of restaurant, without additional Planning Commission and/or City Council <br />approval of that use. <br />Commissioner Gasongo questioned projected land use on that part of Lexington from County Road B to <br />Larpenteur Avenue; and opined it may all become commercial, thus having little impact on adjoining <br />residential areas. <br />Mr. Lloyd clarified that, using the Comprehensive Land Use map, and future land use designations, <br />indicated that it was guided for single-family residential uses; and any change would require a 4/5 vote of <br />the City Council. Mr. Lloyd noted that there was high density residential in a limited area adjacent to the <br />proposal. <br />Chair Bakeman noted that this area of Roseville had been settled as a business community before the <br />City of Roseville existed. <br />Additional discussion included fencing provisions and types, or whether additional landscaping or “green” <br />screening could be provided; and screening for the trash enclosure; no provision for an outdoor patio <br />area. <br />Commissioner Wozniak questioned whether restrictions would be advisable on traffic existing (i.e., “No <br />Left Turn” onto Lexington Avenue). <br />City Engineer Debra Bloom advised that she would not recommend such a provision, as there would be <br />no way to enforce it, with no median and full access now allowed for other businesses. <br />Applicants, Michael Schueller and Catherine Hussain <br />Mr. Schueller advised that a pick up window had been initiated by him, to allow faster customer flow to <br />avoid any parking lot congestion. Mr. Schueller further advised that he had no problem in eliminating it if <br />the Planning Commission recommended doing so. Mr. Schueller clarified that he had no intention of <br />installing a menu screen on the outside of the building. <br />As Chair Bakeman clarified those items discussed earlier by Commissioners and staff, Mr. Schueller <br />responded accordingly: indicating his willingness to work with staff to provide coniferous screening along <br />the west property border rather than a fence, and to work with staff on an appropriate location and <br />screening for the trash enclosure on the north side of the building; and clarified that, with addition of <br />equipment and counters, he anticipated that only 12-15 seats would be available for service in the facility <br />along the eastern wall. <br /> <br />
