Planning Commission Meeting <br />Minutes – Wednesday, December 05, 2007 <br />Page 6 <br /> <br />MOTION <br />Member Boerigter moved, seconded by Member Doherty to RECOMMEND APPROVAL of a <br />requested ZONING TEXT AMENDMENT to Section 1002 Definitions – Dog Kennel to exclude pet <br />boarding and/or daycare as an accessory use to pet and pet supply store and Section 1005.015 <br />Use Chart to include pet boarding and/or pet daycare as a conditional use in all zoning districts <br />where pet and pet supply stores are permitted or conditional uses, for Rosedale Commons LP and <br />PetSmart within Rosedale Commons shopping center, 2480 Fairview Avenue, based on the <br />comments in Section 5 of the project report dated December 5, 2007. <br />Ayes: 7 <br />Nays: 0 <br />Motion carried. <br />MOTION <br />Member Boerigter moved, seconded by Member Gasongo to RECOMMEND APPROVAL of an <br />AMENDED CONDITIONAL USE PERMIT (CUP) for Rosedale Commons LP and PetSmart allowing <br />pet boarding and a doggie day camp within Rosedale Commons shopping center, 2480 Fairview <br />Avenue, based on the comments and findings of Section 6 and the conditions of Section 7 of the <br />project report dated December 5, 2007; <br />amended as follows: <br />? <br /> Condition A: language amended to read: “Pet boarding within PetHotel shall be limited to <br />accommodations for 108 dogs [KENNELS] and 15 cats [KENNELS] within a 5,012 (+/-) square <br />foot fully enclosed indoor facility;” <br />? <br /> Conditions B and C: pick-up/delivery of pets for boarding purposes: language amended to <br />allow for drop-off for pet boarding, daycare and/or grooming (animal services) not before 7:00 <br />a.m. AND hours of operation 9:00 a.m. – 9:00 p.m. Monday through Saturday; and 10:00 a.m. – <br />6:00 p.m. on Sunday; with drop off of pets allowed at 7:00 a.m. for boarding, grooming or day <br />care purposes; with no pick-ups to occur after specifically-designated daily hours of <br />operation; commensurate with the operation of the facility. <br />Ayes: 7 <br />Nays: 0 <br />Motion carried. <br />Chair Bakeman advised that the Case was scheduled to be heard by the City Council at their January 14, <br />2008 meeting. <br />Chair Bakeman noted that the agenda had been amended to hear Project File 0011 at this time; 8:27 p.m. <br />e. PROJECT FILE 0011 <br />Consideration of revisions to the City Code that would clarify the text pertaining to cul-de-sacs <br />and eliminate contradictory references <br />Chair Bakeman opened the Public Hearing for Project File 0010. <br />City Engineer Deb Bloom reviewed recent court action (October 8, 2007, Ramsey County District Court – <br />Boryczka v. City of Roseville); and the court order and judge’ s ruling that the City had been incorrectly <br />interpreting City Code, Section 1103.021D (Cul-de-sac Reductions). Ms. Bloom reviewed the history of <br />staff interpretations that reduction in the right-of-way cul-de-sac dimensions could be approved if any of <br />the three (3) criteria were met; and the judge opining that all three of the criteria must be met in order to <br />allow sub-standard cul-de-sac. <br />Ms. Bloom reviewed existing cul-de-sac inventories, their locations, and relevant code sections; with staff <br />recommending, along with the City Attorney, that City Code language be revised to conform to previous <br />City Council decisions by initial amendment to consolidate and clarify references to cul-de-sacs and <br />turnarounds; based on Attachments A and B of the staff report. <br />Discussion included process of staff’s preparation and presentation of feasibility reports for future <br />construction projects; process for unusual circumstances for the cul-de-sac approval process previously <br /> <br />
