Proposed ordinance <br />(a) No landlord or any agent of the landlord to make any inquiry, compile, disclose, <br />report, or provide any information, prohibit offering or continuing to offer, <br />accommodations in the property for rent or lease, or otherwise take any action regarding <br />or based on the immigration or citizenship status of a tenant, prospective tenant, <br />occupant, or prospective occupant of residential rental property. <br />(b) No landlord or any agent of the landlord shall do any of the following: <br />(1) Make any inquiry regarding or based on the immigration or citizenship status <br />of a tenant, prospective tenant, occupant, or prospective occupant of residential <br />rental property. <br />(2) Require that any tenant, prospective tenant, occupant, or prospective occupant <br />of the rental property make any statement, representation, or certification <br />concerning his or her immigration or citizenship status. <br />(c) Nothing in this section shall prohibit a landlord from either: <br />(1) Complying with any legal obligation under federal law. <br />(2) Requesting information or documentation necessary to determine or verify the <br />financial qualifications of a prospective tenant, or to determine or verify the <br />identity of a prospective tenant or prospective occupant. <br />(d) Severability: <br />If any section, subsection, sentence, clause, phrase or portion of this ordinance is for any <br />reason held invalid or unconstitutional by any court of competent jurisdiction, such <br />portion shall be deemed a separate, distinct and independent provision and such holding <br />shall not affect the validity of the remaining portions thereof. <br />Rational <br />1. It would help protect landlords. Landlords would not have to worry about <br />potential liability if they rented a property to someone that did not have a legal <br />immigration status. Landlords won't be punished for renting to illegal immigrants. <br />2. Roseville's image would be improved as it would be seen as a community that <br />welcomes all people (as noted as the first goal in the Roseville 2025 visioning <br />project). <br />3. With our incoming school age children reaching a 40% level of diversity, such an <br />ordinance could eliminate any potential risk of discrimination in the future. This <br />would help put Roseville in a position to succeed. <br />
